6:17Thank you through you, Mr. Mayor

6:20My motion is that the city council recognizes the requests of the Mississauga's of the credit first nation to the city of Guelph and

6:28The support of the six nations of the river as well as the ecological social

6:33reconciliation and economic benefits of a national urban parking wealth and move to support urban park wealth and the premise of House of Commons petition e

6:424593 notwithstanding other public uses or current staff direction

6:47And I have a little preamble if you'll all indulge me

6:52Yes, I just need a seconder

6:55Councillor Goller will second that so now that's formally on the floor you can go ahead with a little preamble. Okay. Thank you very much

7:04So we have an opportunity to support an idea today a good idea

7:09Potential outcome that would not only result in federal funding for a national urban parking wealth

7:14That would help us conserve the green space in the Yorklands

7:17But also create partnerships in the community and indigenous nations who we know are supportive or supportive of this project

7:24A national urban park on the property would mean a coalition of interested parties would run and maintain an

7:29ecological and economic when fall when fall right on the edge of our city

7:353191 people signed the petition to the federal government

7:3842 groups endorsed the project including six nations of the Grand River

7:41And we've been directly called upon by the Mississauga's of the credit first nation to work with urban park Guelph on this project

7:47But all I'm asking for today is to acknowledge. This is a really good idea

7:51Well, Francis and our indigenous partners want this

7:55The other day I walked with Cliff Summers who was incarcerated at the Guelph Correctional Institute at the age of 17

8:01It was an adult facility

8:02He emailed us all a couple weeks ago to explain how he ultimately began the Nilo program that established sweat lodges at the GCC

8:10Which expanded to other prisons while he was incarcerated at Guelph?

8:14Indigenous history was made on for human rights on that land

8:17And I'd like to reach you words emailed me emailed to me from Bruce weaver who most of you all know I

8:24Wish to express my strong support for your motion. It is vital that as the years pass we continue to work towards reconciliation

8:31Guelph is far behind our neighbors and doing meaningful work here. We have an excellent opportunity to put action into reconciliation

8:38We have the support of the Mississauga's of the credit first nation elected chief and counsel

8:42We have supported the shone and we have supported many of us in the guelph in

8:47Indigenous community

8:48Some of the living members of the native sons have concurred with my belief that we can move the York lands from a place of

8:53incarceration to a place of healing

8:55So my motion makes no demands of staff and it costs us nothing

9:00it allows us to follow the intentions of our land acknowledgement and

9:04Support the ideas and wishes of our community and indigenous partners, and I hope that you all will support them with me. Thank you

9:22Yes, so so we were just informed via email this morning that staff would want a

9:30Additional motion if this was supported and that they would pause the work

9:36On the on on the heritage conservation district

9:41Until such time that confirmation has been received from the federal government in writing

9:47And that an urban park is not viable or if direction from the provincial government as a land order confirms

9:52No urban park is viable. So this has me

9:56concerned

9:57Well, I'm concerned that this came last minute

10:00This wasn't information that was available before the last meeting, but if I could ask staff

10:07Because the the motion was worded particularly by counselor Katon that

10:13Not withstanding other public uses and current staff direction

10:17So it would seem that

10:19Any anything contrary to what our current staff direction is with this additional motion would be

10:26Contrary to the current motion that's on the floor, but also is there

10:33She she my understanding is she vetted

10:36Make sure that that these couldn't happen concurrently. So is it that?

10:41staff don't want to do them concurrently or is it just that that

10:46They can't possibly happen concurrently because to me to to put forward this and then another motion that says

10:55And as the land order confirms no urban park is viable could be like a hundred years

11:00I mean they could confirm they could never confirm that so like I just

11:04It's it's not making sense to me. This is all new information and I'm very concerned about it

11:12Through the chair counselor downer there was a few points there

11:15So the first was on the timing of this the staff comment on this

11:18So the motion by counselor Katon was not put on the floor until until today

11:23So we did not have a chance to comment on it. So that's the timing on the motion today

11:28It was not put forward on November 13th

11:32as for

11:34the urban park

11:37Either and we'll be told council when we started this the provincial government is not subject to municipal heritage policies

11:44The federal government is not subject to municipal heritage policies

11:48If the motion for a national urban park moves forward and and that's still yet to be decided

11:55You know from our perspective, there's really no point to advance this work

12:00The national urban park program, I believe they have a deadline of

12:062025 to identify six potential new parks

12:10So I think there is a time limit on this and it certainly could be revisited by council if there's a period of time that we don't have an answer

12:17But the official plan policies for this area allow for adaptive reuse from York

12:23Almost to Dunlop without the NHS areas the official plan policies in the adaptive reuse

12:30Would include a mix of uses which are institutional educational commercial office light industrial and that is

12:38Against the motion that council or that council Kate and is put on the floor today. So

12:44You know from our perspective while it's under consideration

12:48It's really not the best use of staff resources to create policies that may not

12:56Go forward or may not be

12:58Used by the future owner if it's a if it's a federal park

13:03You know so for us

13:06It's we'd prefer our position is pens down and pause and wait for this outcome. It's not forever

13:12the

13:15Significant structures are designated part four already and there is that level of protection on some of the structures

13:22So it's certainly staff's position that if this urban park motion goes forward that we do a we do a big pause on this particular project

13:29to move forward with some of the other

13:31Heritage designations that will expire at the end of 2026. So I understand that all those uses to be Mr.

13:38Are would are included then in the

13:42The conservation district but but that doesn't preclude it from

13:46Having an urban park as this is suggesting because it's

13:50Her motion says notwithstanding other public uses

13:55So why would it not include I mean it could be even if it's an urban park

14:01They might they might want to

14:03Adaptive use of those buildings there could be the federal government could want to lease out space for offices other than the

14:11ones associated with that. Why would that not

14:14Be all encompassing within that if that happened

14:18Through the mayor the counselor and if it is owned by the federal government or a federal urban

14:23federal institution, they're not subject to the policies. They're not subject to the

14:28The policies that council would approve. So right that's the intent that it be paused

14:34It's not to say it won't be picked up at any point in time that it just be be paused until until this is this is outcome is no

14:41So they they might not be subject to it, but I'm sure they'd have respect towards

14:47Towards it having the completed work done

14:50I would hope

14:52There's nothing stopping them from doing that. That's what we do not know. We do not we do not know

14:57So we don't know what the protection might be or

15:54Previously brought this to staff as I had had staff conversations back and forth and email and moderated my

16:01Motion to take out things based on the the commentary. So I did have advanced conversations with staff as all. Thank you

16:15She actually she actually indicated that you did have the conversations with staff

16:19I was replying to to miss walkie's comment that

16:23They had not seen it until

16:25It was tabled

16:28Yeah, okay, so I think I

16:31Now we're going to get into back and forth and I want to be careful how much we do that but cam I'll go to

16:36our deputy

16:40And then potentially um back to krista and then I would like to move on with my speaker's list

16:47Councillor Caton did distribute her motion to all of council and the executive team in advance and we did have a back and forth

16:53discussion with her on the specific clauses of the motion, but that was in the context of

16:58specifically the relationships with our indigenous partners and some current concerns that we flagged about

17:04How the wording

17:06Was or was not reflective of what we as city staff knew in writing from those indigenous partners who were named

17:12In that back and forth there wasn't any discussion about how this would impact on the other motion that was on the

17:19Potentially on the floor because we couldn't presume an outcome of what was going to happen on the 13th

17:24I think what miss walkie and I won't put words in her mouth

17:27But what I think she was trying to say is that we as staff had no opportunity on the 13th to comment on the impact of one motion

17:35Versus another because the meeting was recessed

17:47I just want to wrap that up. So that's fine. And then before I go to councillor caron point of order. I recognize you councillor all

17:58I'm a bit concerned that we're conflating a motion that is on the floor with a potential motion that councillor Goller might bring back

18:06We have a motion on the floor right now that irrespective of the past dialogue and report that's gone on

18:12Stands on its own merit. And I think we should be dealing with that first

18:16Determine whether it stands or fails and then go to councillor Goller's motion if he deems it still relevant

18:25Yeah, so I recognize your point of order and I agree with you as the chair. That's my ruling that

18:31What's happened is is that what's on the floor right now

18:34Is just councillor caton's motion any other motion?

18:40That is considered around pausing

18:57I'm going to go caron and then I think back to alt and I'll continue with my speaker's list

19:07The problem that I'm struggling with is that councillor caton's motion

19:11The outcome of councillor caton's motion

19:15Sets into motion other things that staff are telling us they are recommending they pause doing

19:22And so I want to ensure that those two things are not mutually exclusive before I

19:29Before I vote on the motion that's on the floor and the reason I have a problem and a dilemma with that is that

19:37I'm being told that

19:39Part four designations are already in place and will protect certain buildings

19:43But we know through the conservation plan and we know through all of the historical research that's been done

19:49There's a there's a significant number of buildings

19:52And and structures there that are not protected by part four designation

19:57We've got the woollen mill the quarry the twash tressle bridge the native sun's room the mural in them in the main building

20:03There's a whole list of buildings that we know have cultural significance that are not protected

20:07And the only way they will get protected is in the the conservation district plan

20:13So I can't talk to yeah, sorry if you don't mind that councillor Caron

20:18So let me be really really clear and the I mean staff can jump in if uh, if i'm saying something wrong

20:26Where you're where you're heading is logistically correct and logically correct

20:31Except respectfully

20:34It is only staff's recommendation that we pause

20:37If council deems that that recommendation is not necessary as a body of council

20:43We can say thanks for the recommendation

20:46But we don't agree. We would like you to continue your work

20:49period

20:50So I don't think they're mutually exclusive to the point of

20:54um of this versus that

20:57That would be staff's recommendation

20:59But as the body of council we can decide to say we we hear you

21:04We think you should put the pen down, but we don't want you to put the pen down

21:06We want you to keep using the pen and keep working even if this one were to pass to so staff

21:12Am I am I portraying that correctly for council as a body to understand?

21:25I am in principle supportive of where we're going with this recommendation with what and thank you to councillor kate for bringing it forward

21:32Because we have heard this conversation in the community for months. What well beyond a year two years now

21:38And there's significant community momentum to have this before council for a further discussion

21:44So my comments and my questions are process and you know, you all know i'm a process girl

21:49So there's been no community consultation on this motion

21:53There's been no engagement in the community

21:58city led

21:59planning led

22:01About an urban park on this site

22:03We've had loads of city led conversation on the gid and the zoning from the gid and all the potential uses in the gid

22:11I want to move forward with exploring the urban park

22:14But I want to know that there's going to be a proper planning process

22:19That will have that engagement as the next step

22:24And I think i'm looking for the mover or for staff or both to say if this passes here tonight

22:31What is the next planning process that will need to be put in place so that we have a robust city led

22:39planning engagement

22:43Activities

22:45That we would normally have for anything as significant as this and I recognize

22:50That the community group has done a lot of that and we're hearing that that

22:56Desire to create an urban park is there in the community

23:00But I want to make sure we follow proper planning processes if this motion passes. So how do we do that?

23:10Or is the planning process the hcd?

23:18I guess i'm just looking for a staff member

23:20I I was under the impression that there really isn't a planning

23:23Position of the city that the position of an urban park is community led we can all agree with that

23:30Um, and that's it like it full stop. I don't think our staff would do anything further from that because it's a community led

23:39application-based

23:41process to try to engage with the federal government

23:44To try to get the yes of of making it into a national urban park

23:49I don't think there's anything

23:51From us on our end, but I staff them again. I don't I just want to make sure

23:58I it's not about me answering. I'm sorry if I jumped in there. I

24:01No, that's that's okay. So right me or yeah to you mr. Mayor. I think we're on the same page as you

24:06We're not really quite sure what the requirements would be so I don't I don't really have an answer for you

24:15Yeah, so maybe could I could I then um bring that back to the mover with with all due respect?

24:20I again, you know that I that this is is something I highly value and want to see move forward

24:29But there hasn't been a public

24:31process

24:34Here today like your your motion we all got it on november 13th

24:39Um, the public didn't get it on november 13th

24:41So how do we get the public to be able to delegate on this matter?

24:45We were not permitted to have delegations here today

24:49And and I understand the the the governance and rules of order reason why not

24:55But the lack of ability to have the public delegate on councillor katens motion

25:05Thank you. So, uh, I guess councillor kate. I'm going to just jump in here as the chair to try to help

25:11Councillor Caton did a very good job

25:14Uh in informing the entire community that the motion was coming forward

25:17That's why we had like an over an hour and a half of delegations the other night

25:22And I don't know 50 60 70 letters saying that we should do it

25:26I I would submit

25:28That this community has known and outside of outside of our council process with over 3000 people

25:35Signing a petition. I would suggest that the community knows

25:39I think what your question is from a process perspective is is there a city led process

25:46Based on this motion that's in front of us today and our staff have said no

25:50There isn't so I would let they'll let the mover

25:54Um, correct me if I if I if I'm not there, but the community certainly has known and they did delegate

26:01Already so to the mover and I'm back to councillor Caron

26:05Thank you. Through you mr. Mayor. Um, I I agree that the the community has spoken on this

26:11We've received many many emails. They've been doing their engagement processes and the

26:17The national urban park is not meant to be

26:21municipally led

26:22This is meant to be something that is led by the federal government as well as the indigenous nations who are asking us

26:29To engage on it and the community members. So this is something that would be

26:36not

26:38incurring any staff time or staff money and it is

26:43A community led process

26:45So that would be kind of imposing ourselves upon that process

26:49And I think that we need to let it play out in terms of them and them making their

26:54bid to the federal government

26:58Bingo, and I think you've just you've hit the nail on the head is I was worried

27:02We were missing a governance piece by not having this motion on an agenda

27:08and then allowing delegations on this motion and you've

27:13You've wrapped that all up in a nice bow for me. So thank you very much

27:23I do appreciate the motion coming forward and from my very simple perspective

27:28I see the motion as acceptance and principle of a community driven initiative in which the city is providing its endorsement

27:35Of that particular principle at this point

27:38I would think that we can see that there has been some a critical mass that has developed 500 lawn signs

27:54Numerous letters that have been sent to the city on this

27:58I also want to recognize something very important that I heard councillor Caton state that this provides a

28:05Fundamental anchor in the process of reconciliation

28:09We make acknowledgement of the truth element when we do the territorial acknowledgement

28:14This captures the vision of indigenous heritage and guelph

28:19However dark it might have been in the correction center

28:22But which had much positive come out of it including healing circles and a number of other things

28:27I think that this is a positive statement for guelph to send forward

28:31This is something that we believe in because the community believes not only should we give credence to truth

28:37We should work on reconciliation in a very concrete fashion

28:42Or orc and then Gibson questions, please

28:56Uh, I think the word notwithstanding is used in lots of different ways in lots of different contexts

29:01So can you explain to me when you say notwithstanding?

29:16That that land could be used for another public purpose potentially, but that it hasn't been ruled out

29:33But I don't know it's at the cost to what so can you just tell me right like are we making a choice today?

29:39Because if we're making a choice then I don't think that choice has been fully debated in the public

30:19So this does not say that this is the only good idea, but we think that it would be a great idea and

30:25We would love it if that were to materialize, but it does not mean that we are saying no to other public uses

30:39I'm just curious because I took a quick look around the urban

30:42National Urban Park website and there's a lot of different models there in terms of

30:48What those urban parks look like so some are partnerships with the municipality some are partnerships with indigenous nations, etc

30:58Is there are we at the point of a model?

31:01And my concern there also is then what's the expectation?

31:05Is the expectation that we support an urban park?

31:08And then that the city repair the trestle bridge

31:12Do the adaptive reuse because that is also a very different

31:17budgetary conversation than an approval in principle. So I'm just wondering

31:21What's the model and what is it?

31:24Specifically that we're being asked to say yes

31:29Thank you sir the mayor um the models are determined based on

31:34Who wants to come together to be a part of the plan? So the models are

31:41Variable because different groups have all decided in the different in the other locations

31:45whether or not they want to be participants in

31:48Maintaining and running the the national park

31:51So it would be up to us to decide at the time if it gets selected by the federal by parks Canada

31:59Whether or not we wanted to be a part of that or not

32:03So that would be a later decision and it would not be something that we would have to

32:07Sign on on and then we could actually make more of a

32:11you know engagement process at that point

32:14And see if there was budgetary constraints, but that's not something that we need to decide right now right now. We're just

32:21endorsing the principle of the project so that

32:24Parks Canada knows that urban park wealth has a layer of support

32:31So through you mega three to the mover again

32:35Does the community not have to go to parks Canada with a proposed model?

32:41Or just say hey this land is here and could it be a national urban park like I am trying to understand legitimately

32:50What this looks like and what the expectations are?

32:54they've gone to our indigenous nation partners and

32:59that so the missus august of the credit

33:02First nations they have

33:04sent out the letter which I've sent out to all of council that says that they would like us to work with urban park wealth

33:09and

33:10That would be a later discussion

33:12so

33:13Right now those are the community members and the indigenous nations are the ones who are signed up

33:19towards

33:20realizing the park should the park be chosen and

33:24We have made no commitment to that and mic motion makes no commitment to that

33:30Okay, thanks, and um through you mayor guthrie to the mover just a last question

33:38Do you know if this motion becomes an encumbrance at all on other potential uses?

33:43I mean our own mpp is is

33:46hesitating until he sees what the other potential uses are

33:51So I I'm I'm just trying to leave our options as open as possible for another really critical

33:59Community use I'm just trying to understand what the trade-off is

34:03With this particular decision. So do you know if if this support

34:07Creates an encumbrance to that

34:10Thank you to the mayor it shouldn't not the way that I've written it

34:13I've written it specifically so that it doesn't do that and I can't speak to what our mp

34:20Has said in the past only to the letters that I've seen where he had stated that

34:27The parks canada process was closed and we found out that it wasn't so I'm not sure I can't really I don't want to pre

34:33suppose

34:34His position on on that, but sorry. I was referring to our mpp, right?

34:39MPP or MPP who who is you know continuing to

34:43Leave the option open for the use of that land

34:47Until there's some more clarity

34:49Again, I can't comment on that because he's not here for us to ask questions too, but

34:55My motion does not

34:57preclude any of those things. It's very specific to being left open to other public uses

35:15Just educating myself over the last few days on the the creation of these new urban parks through the federal government

35:21I'm only familiar with the Rouge

35:25Valley or the Rouge River National Urban Park

35:28Sounds like the government's open to creating

35:32upwards of six more

35:34um

35:35I just need to be realistic about

35:38two

35:39national urban parks

35:42In southern hotara within an hour of each other

35:44our

35:46Are we risking pausing our heritage work here?

35:49um

35:50for a realistic for just for a realistic ask like what are the

35:55In staff's professional opinion

35:57What is the candidacy

35:59For the York lands to be a national urban park? I mean the Rouge River is spectacular. It's an entire watershed

36:05Um, what are what are what are we looking at here? I think um

36:20I think councillor our staff are very

36:23much in a position of not knowing because this is community led

36:28and um

36:32And so they're they're they're indicating in the room here that there really isn't an answer to that

36:37um

36:40In a way, this is a very political

36:43um
