0:01Good afternoon, Gleif. I'd like to call to order the May 11th hearing of the Committee of Adjustment for the City of Gleif.
0:07This hearing is being held in a hybrid format with attendees appearing in person or remotely and is being live-streamed and recorded.
0:15Please be advised that public hearings form part of the public record and the words, images of
0:25those participating will be recorded and posted online.
0:28I've confirmed with the Secretary-Treasurer that we have a quorum to proceed.
0:34Before I outline the hearing format, I wish to speak to an application that's listed on the agenda
0:39if you wish to speak to an application that's not listed on the agenda and have not submitted a request in advance of the hearing.

1:49Afterwards, the applicant will be given an opportunity to add anything further to their application to a maximum of 10 minutes.

2:03The committee will then be able to ask questions of the applicant or staff.
2:10After that, we will hear from members of the public who wish to comment on the application.

3:15When the committee is making a decision on an application, the chair will be asking the secretary treasurer to conduct a vote by roll call.
3:24The secretary treasurer will call each member's name and each member will respond if they are in favor or opposed to the motion.
3:32And the chair will announce the result of the vote.

4:23As we gather, we're reminded that Guelph is situated on treaty land that is rich in indigenous history and home to many First Nations, Inuit, and Métis people today.
4:35As a city, we have a responsibility for the stewardship of the land which we live and work.
4:41Today, we acknowledge the Mississaugas of the Credit First Nation of the Anishinaabe people whose traditional territory we are meeting.

12:45Christie Pollard and Chris Ligori. And can you tell me if the sign was posted as per the planning

13:10Thank you, Mr. Chairman and committee members. We're asking for two variances.
13:18First variance is a front yard setback of 4.76 meters versus the allowable
13:266 meters. And a second variance to allow for exterior stair to the lower level.
13:32We're requesting that it encroach into the front yard setback of 2.7 meters versus the allowable
13:435 meter encroachment into the setback. If we could pull up drawing a 012 and I can walk you through
13:57the reason for our request. Drawing a 012, please. That is the proposed segment. Yes, there we are.
14:20The dark gray area is the footprint of the existing house,
14:28ground floor footprint. If we can zoom in to that footprint, thank you and maybe even a little
14:54farther if you can. There's some dimensions on the front yard and slide to the right a little bit.
15:01Yeah, thank you. That's good. So the dark gray area is the existing footprint of the house.
15:09170-year-old stone farmhouse and there is a dashed line on top which is the proposed
15:21second story footprint. We're proposing to remove the existing second story and replace with
15:28a new second story and that new second story encroaches into the allowable front yard setback
15:40by 1.24 meters leaving a request for a front yard setback for that second floor of 4.76 meters.
15:50If you zoom in a little closer to the front yard dimensions, it can get really quick. Yeah,
16:01there we go. You can see the existing front yard setback is 3.86 meters. That's at the closest
16:10corner to the property line and then further west or up in this diagram is the setback of
16:224.76 meters going to the corner of the second floor and there's a little triangle
16:29of area of the second floor that encroaches into the front yard setback of our proposed second floor
16:36construction. That's the reason that we're requesting that reduction on the required
16:47front yard setback. And secondly, you can see on the site plan there is a stair
16:53coming from that elevation. That is a stairwell to enter the basement level of this structure
17:05and in order to allow for a door to open outwards and have enough landing when the door is open to
17:12be able to move through into the space, we're requesting to be able to encroach into the
17:18front yard setback by a dimension of 2.74 meters. Those are there are two requests.
17:26There has been a staff report. I believe that you've all received staff's recommended approval
17:34for the variances. We have also been in deliberation with heritage planning. Heritage staff have no
17:41concerns with the requested variants. Engineering services, they agree with the recommendations
17:47of planning and building staff as well as building services have no concerns.

26:16this was an approved severance a part of the conditions of the severance on Queen Street,
26:23the three properties. The engineering design, there was an existing sanitary easement that was
26:32found that ran from 72 lion to the to the west onto one of the subject properties.
26:41And part of the engineering design was to create this easement in favor of 72
26:49over the subject lands, two of the subject lands. And that's that's why we heard it create this
26:55easement. Well, thank you. That was concise. Committee members, do you have questions of

28:59presentation from planning staff about the comprehensive zoning bylaw changes and an
29:05update on the official plan. So I will turn it over to I see Abby Watts for her presentation. Welcome.
29:17Hi, thank you. So yeah, my name is Abby. I'm the project manager of the comprehensive zoning
29:25bylaw review that recently went to council for approval on April 18. Trista, are you
29:33changing the slides or am I? Okay, so just I don't have a slide on official plan amendment 80,
29:45but I'll just briefly speak to that piece. So official plan amendment 80. We received a decision
29:54from the province a week before the 18th. I don't have the the date in my in my mind. And basically,
30:04official plan amendment 80 was the city's municipal comprehensive review, which updated our growth
30:10plan targets to 2051. So we were working concurrently on the new zoning bylaw at the same time that we
30:19were working on official plan amendment 80. So the new zoning bylaw doesn't incorporate any changes
30:25that were brought about through OPA 80, or any of the provincial changes that happened through that.
30:32So that will be a future zoning bylaw amendment that will come forward to council.
30:37So back to the zoning bylaw piece. As I mentioned, council approved the comprehensive zoning bylaw on
30:46April 18. This new bylaw totally repeals and replaces the existing 1995 zoning bylaw for all
30:54lands within the city. Notice was mailed on April 27, meaning the last day of appeal is May 16 at
31:044 p.m. So we will know next week whether we have appeals to work through on that on this bylaw.
31:11Until that time, both of the bylaws are in effect. So we have the 1995 zoning bylaw and the 2023
31:19bylaw until we are able to resolve any appeals or scope the appeals down to site specific properties.
31:28So what that means for development and minor variances is that any proposal
31:34has to conform to the 95 and the 2023 bylaw. And so you'll probably be seeing some applications
31:42if you haven't already that do that. So section 1.3, or maybe just to back up,
31:51my presentation today is really about what's new and changed in the new zoning bylaw. So
31:58regulations that we didn't previously have, I'm just going to highlight those for you.
32:03And then some revisions to existing regulations. I know sometimes we know the 95 bylaw so well,
32:09so there might be small tweaks that I'm just going to point out to you. There'll be an opportunity
32:14to ask questions at the end. And then obviously you can reach out to me at any time if you have
32:19additional questions about the new bylaw. So section 1.3 of the new bylaw is transition provisions.
32:28Essentially this section expires two years after the effective date of the new zoning bylaw. So
32:34that's the April 18th date. Transition allows for existing applications submitted before April 18th
32:42to continue to comply only with the 1995 zoning bylaw and not have any of the new 2023 regulations
32:49applied to it. So for building permits, that means anything that we accepted before April 18th can
32:55continue to apply with the 1995 bylaw for a maximum of two years. For minor variances,
33:03anything that was granted before April 18th has to apply if a building permit is required. They'll
33:10need to apply for a building permit within those two years to make sure they maintain
33:15the permissions that were granted. And generally, minor variances to the 1995 bylaw aren't carried
33:21forward indefinitely in the new zoning bylaw. So after the two-year transition timeframe, any of
33:29those previously granted decisions will become legal non-conforming or legal non-complying. So
33:36if someone had a side yard variance to add an addition, they wanted to expand that addition a
33:43little bit, they'll be back at the committee of adjustment to request that in the future.
33:50And then site plan is a little bit more complicated, but generally follows the same
33:55principles. There's a maximum of two-year transition period, but one site plan approval
34:02is granted. There's a 90-day requirement to get a building permit. And then there's also some
34:07additional built-in time for multi-phase developments. So up to five years when there's multiple phases.
34:18General provisions and parking is probably the large amount of committee of adjustment
34:24applications that you see. So I'll kind of go through some of these standard regulations for you.
34:33So additional residential dwelling units. This is an amendment that we made in 2020 to permit
34:43the additional residential dwelling unit within the primary dwelling and then one in a
34:47detached structure in a rear yard or a side yard. So this section was just revised to align with Bill
34:5423 changes, which allows two additional residential dwelling units within the primary
34:59dwelling. So for a total of three within the main building, or one within the main building and one
35:05within the detached structure. We also made an amendment that allows basement apartments to
35:11have three bedrooms. So previously that was two, but they are allowed to have three. Any
35:19other unit located on upper floors or in detached structures are limited to two.
35:26And then council amended the proposed bylaw on April 18th to eliminate the maximum
35:32size of detached ARDUs. So previously there was a requirement that they couldn't exceed 80 square
35:38meters and that's no longer the case. However, they are still limited to 45% of the gross floor
35:45area of the house as well as 30% of the yard. So there are still some limitations to the size,
35:51but larger lots might exceed the 80 square meters in the future. Home occupations,
36:00these regulations have been revised. So the permitted size has changed. It's now that they
36:07can't exceed 25% of the gross floor area of the dwelling to a maximum of 50 square meters.
36:14They are now permitted within accessory structures. So that previously wasn't the case.
36:20And they're also permitted in additional residential dwelling units. So if the home owner of the
36:27primary dwelling, dwelling unit builds an ARDU and they want to have a home based business,
36:33they can occupy the ARDU with their business. We've really simplified the parking. So hopefully
36:39if you were getting a lot of variances for home occupation parking requirements, it's pretty simple
36:46now. Basically one for the home occupation. If you have a staff member, an additional parking
36:53space, and then if you have clients coming and going an additional parking space. And we've
37:00updated the regs to now allow medical professionals and make that clear. Medical professionals is
37:07defined, but it is limited to one practitioner per lot. No employees and no other home occupations.
37:19Fences, these regulations have been revised actually in response to minor variance applications.
37:24So we've addressed sort of the corner lot issue where your front door might face your exterior
37:32side yard. And then your technical front yard, which is actually what people consider their side
37:40or backyard, the only like area of their yard that they have. We've updated it so you can have a fence
37:46that's taller in that yard in line with the exterior side yard requirements. So hopefully that addresses
37:53some issues and you'll see less of those applications in the future. So we also have new
38:03complementary uses. So this wasn't previously in the 95 bylaw. And this aligns with the land use
38:10designations of employment and institutional uses. So complementary uses are listed within the
38:16permitted use table. And they're not employment or institutional uses. They're usually like
38:25restaurants or daycare centers, things like that. And they're permitted within a multi-unit building
38:33in combination with a primary permitted use for that zone. Shipping containers, these are brand
38:42new regulations as well. So we're now defining what a shipping container is. And essentially
38:49they're permitted as outdoor storage within employment and service commercial zones. And
38:55then there's a series of regulations. Essentially outdoor storage has to be in a rear yard or side
39:01yard. It has to be screened. Can't be located within parking spaces or fire routes, things like that.
39:10Shipping containers aren't allowed to be stacked. They're not permitted on residential
39:14or mixed use properties on a permanent basis. And then there's some additional permissions to
39:23use them within a storage facility use, you know, that would obviously go through a site plan
39:27application. They're permitted in parks for recreational programming as we have some of
39:32those within our existing parks today. And then we've introduced some temporary uses for them as
39:38well. So residential properties and construction sites can have them for a limited amount of time.
39:45So people sometimes want to put a shipping container in their driveway to do home renovations or
39:50something like that. So permitted but time on a based on a time limit. And then we've also
39:56permitted them as an occasional use. So on a mixed use site or a commercial parking lot,
40:05this would allow sort of pop up sort of markets and different innovative ideas.
40:11But again, on a short term time basis. And then I know we get a lot of questions too about
40:18using them as a construction material, kind of putting them down in a rear yard as a shed or
40:23something like that. And so when they're converted to a building or used as a construction material,
40:31they're no longer considered a shipping container and they would have to comply with these own
40:35standards for that type of building. So if it's a building that they're proposing or a detached
40:42structure, they would have to comply with those regulations and get applicable building permits.
40:50So parking, generally parking has been updated city-wide. So every use has been examined
40:57and updated. We've updated our accessible parking requirements as well to align with the
41:03AODA requirements provincially. We've expanded our bicycle parking space requirements city-wide.
41:10Previously we just had those downtown. And we've incorporated new parking space design and location
41:16requirements. So that's making sure that bicycle parking spaces are actually accessible and usable
41:23located close to pedestrian access access doors and things like that. We've also incorporated
41:30electric vehicle parking space requirements, which is brand new. And we have new vehicle
41:36service station drive-through facility and car wash regulations as well. So this is mostly dealing with
41:43setbacks from residential properties where drive-throughs can be permitted on a property
41:49and then stacking space requirements as well. So we've incorporated a new parking adjustment
42:00areas. This is brand new to the bylaw. So we have a parking adjustment area that reduces the minimum
42:07requirement and adds a maximum, overall maximum requirement within our intensification areas.
42:14So those are our nodes and intensification corridors throughout the city. So I've got a
42:21map there that shows how to identify when a parking adjustment area applies to a property.
42:27You'll see the RH7 is the zone and then in brackets is the PA. And so that means that the
42:32parking adjustment applies on this property. In all other areas of the city, the last column of
42:39table 5.3 provides the general parking rate. Parking space dimensions have been updated.
42:52Oh, sorry. So first we've introduced compact parking space dimensions. So
42:5715% of the required parking spaces are able to be a little bit smaller.
43:03And that's brand new. And then we've revised the existing parking space dimensions
43:08for apartment buildings, mixed use buildings, stacked town homes, and all non-residential uses.
43:16So it kind of consolidates the exterior interior requirement to 2.75 by 5.5. Today it's exterior
43:26is 2.5 by 5.5 and interior is 3 by 6. So just minor changes, but things that you might see
43:36at the committee with applications. We've also introduced a minimum attached garage size. So
43:43this is for single semis and townhouses. Today we require a space to be 3 by 6 meters. But the 2023
43:53bylaw introduces an overall minimum of 20 square meters. And this is to accommodate
44:00the city's standard garbage bins. It becomes a bit of an issue with town homes when there's nowhere
44:06to put them, but right in front of your garage because you can't navigate around your building.
44:17Residential driveway widths have been updated. Council made some changes at the April 18th meeting.
44:27So typically we were maintaining that 50% lot frontage with the proposed bylaw.
44:35And that's essentially stayed for single detached dwellings. However, semi-detached dwellings were
44:42increased to 60% of the lot frontage and town homes are 65% of the lot frontage. So adding a
44:50little bit more width, but not necessarily the two car side by side that could fit within that space.
45:02And we've introduced accessible driveway widths. So as far as we can tell, this is probably one of
45:08the first bylaws in Ontario to address accessible driveway widths. And it's really the semi-detached
45:15in townhouses that have the essentially one car driveway. This is to allow an accessible vehicle
45:22to use those driveways and widen them slightly. So this allows type A accessible parking space,
45:32which is 3.4 meters wide. And then it incorporates an access aisle, which is 1.5 meters. And this is
45:39to allow accessible vans that have the side lifts to operate on a property and ensure that,
45:45you know, for human rights and whatnot, there's no additional application required for this type of
45:51driveway in the city. And we have brand new requirements for residential garage widths.
45:59So it is 50% of the lot frontage generally aligns with the driveway width permissions.
46:09And this is to address the built form that has garages across the entire frontage of a property
46:18and a door principal entrance sort of around the side. So we want to see proportional garage widths
46:25with a front door facing the street. So land use zones, basically every property in the city has a
46:34new zone. So you won't see any 95 zone symbols in the new bylaw. And this aligns with our official
46:42plan land use designations. For residential or maybe just generally, every land use
46:54has starts off each section starts off with a permitted use table. So similar to what we have
47:00in the 95 bylaw, just a bit different format. So you can see we have the list of permitted uses
47:05and then the zones along the top row. And then the P indicates where the uses are permitted.
47:12And then any additional regulations associated with those uses are in brackets next to it.
47:21And just to highlight some new regulations for the low density residential zones,
47:26we now have principal entrance requirements. So that's the front door facing the street.
47:31Maximum garage widths, as we talked about, garage location as well. So citywide,
47:39there's a maximum garage projection. Can't be more than two meters beyond the front wall of the house
47:46and in line with a front porch. We allow a mix of uses within our RL1 and RL2 low density zones.
47:53So we don't have a strictly single detached dwelling zone or a semi detached dwelling zone
48:00anymore. There's a mix of uses permitted in all of those zones. Average lot frontage and setback
48:08requirements, which are in map 66, those are still maintained. We just don't call it map 66 anymore.
48:14It's an older built up area overlay. And there's new regulations for the elevation of the principal
48:21entrance for on street townhouses. And so one of the biggest changes to this bylaw is that we've
48:29eliminated exclusionary zoning, as I mentioned. So now we allow up to three units
48:36for every property within the low density designations with RL1 and RL2 zones.
48:43This can be in the form of apartment buildings, on street townhouses and triplexes.
48:50So there are some exemptions for these lots. They're standard residential lots. So they're
48:56exempt from providing visitor parking, bicycle parking, EV parking, and barrier free parking.
49:03There's a new regulation that requires 35% of the lot to be landscaped area. And then generally,
49:11they just have to comply with all the setbacks, building height and requirements in the RL1
49:16and RL2 zones. So essentially the same requirements for a single would apply to a triplex.
49:26And we've introduced some new built form regulations. So generally the zoning bylaw
49:33prezone sites for the maximum height and density of the official plan that was in effect at the time.
49:40And with doing that, we granted a lot more height and density permission. So we wanted to incorporate
49:46built form regulations to make sure that there was adequate transition to adjacent properties
49:52in lower density zones. So these typically apply to medium and high density or mixed use sites.
50:00So you'll see new things like maximum length of buildings, building step backs,
50:05floor plate sizes, tower separations, minimum first story height, active entrance requirements.
50:13So a door every few meters to access the building. We have angular plane requirements,
50:22maximum setbacks and minimum first story transparency. So those are all new things that
50:27you might come across in your applications. I mentioned overlays. So a lot of the existing
50:36overlays have been carried forward. Most of them are in the downtown area around protected view
50:41areas and heights and things like that. So those are all incorporated. We have a few new overlays.
50:48The Brooklyn College Hill Heritage Conservation District is an overlay that limits the height
50:54within that area. And then we have new well head protection area overlays, the Hanlon Creek Business
51:01Park overlay and low density greenfield residential overlay. And we have new online mapping that
51:10incorporates all the overlays. So it's much easier to access this information. I just have a picture
51:15here of the older built up area. So you can kind of just look up your property, apply all the overlays
51:22and see what applies to each property. Holding provisions. Most of the, well all of the existing
51:33holding provisions from the zoning bylaw have been carried forward unless they were lifted during the
51:37review period. A new holding provision you're going to see a lot when you're looking at the maps,
51:42but likely not through applications at C of A is H 12. And so this is where any height and density
51:50permissions have been added. And it requires the H to be lifted prior to development to ensure
51:56there's adequate servicing available on the site. And we still do have a number of site specific zones
52:04in the bylaw. We tried to delete some where there was redundancy, but anything that was approved by
52:11council within the last five years or was the result of an OMB or OLT decision has been carried
52:17forward. And that is just sort of a picture of our new mapping. We have all new maps. The PDF
52:28versions are available at the end of the bylaw. But again, we have the online interactive mapping,
52:33which is a lot easier and user friendly. So for implementation, we are currently working on an
52:42interactive version of the bylaw. It's there's a lot of pages. It's hard to get around. But once we
52:47get the interactive version up and running, it's much easier. There's links that you can jump around
52:52in the bylaw. And it's much more user friendly. We've updated the zoning bylaw with the amendments
52:58that council made on April 18. And those actually have just gone live on the website. So now when
53:06you go to the zoning bylaw page, you'll see a link to the 1995 zoning bylaw and a link to the 2023
53:11bylaw. So everything is available online. And we'll just wait until next week to see if we have
53:16any appeals. And that is the end of my presentation. Thank you very much. That's very informative. I

54:14colleagues don't have any more. You mentioned the what is the ARD use? And there's my understanding
54:24from your presentation is there's no size cap. It's just based on the percentage now. Is that correct?
54:32That's right. But the percentage does provide an overall cap. Yeah. Right. I do recall we had,
54:41I'm going to say two years ago, we had a question about exactly that. It was quite a large lot.
54:47And that's why it came to us. Okay. And in your, you were mentioning the compact parking.
54:57And I wasn't clear what that was involved. Is that just in multi unit residential?
55:03Yeah, that's right. So it's 15% of the required parking spaces can be slightly smaller in those
55:09situations. And the last question I had was attached garage widths, but you didn't mention
55:16carports. Is that something that has changed? No, carports have stayed the same.
55:22That's all I had. Anyone with anything else? I don't see our members online with anything.

57:142023 hearing and the appeal has been afforded to the Ontario Land Tribunal.
