5:58Good afternoon, Guelph. I'd like to call to order the December 11th, 2025 hearing of the Guelph

6:04Committee of Adjustment. This hearing is being held in a hybrid format with attendees appearing

6:09in person or remotely and is being live-streamed and recorded. Please be advised that the public

6:16hearings form part of the public record and the words, names, or images of those participating

6:22shall be recorded and posted online. Before I outline the hearing format, if you're watching online

6:27and wish to speak to an application that's listed on the agenda and have not yet submitted a request

6:33in advance of the hearing, please call the number displayed on the screen now. And that number is

6:40519-822-1260. That's 519-822-1260 and the extension is 2524. You will receive instructions on how to

6:52participate. For those attending the hearing in person, you'll also be given a chance to address

6:58the committee. A final call for delegations will be made when each application is called.

7:04The agenda for this hearing has been posted online at guelph.ca forward slash c-o-f-a.

7:12I'll remind all committee members and staff participating in the hearing to please mute

7:16your microphones when not in use. Applicants will be unmuted when their application is called.

7:22I'd also like to share the hearing format we'll be using to navigate through each application.

7:28Each application will be called by the secretary treasurer and the call-in number for those wishing

7:33to speak to an application shall be displayed on the screen. Afterwards, the applicant will be given

7:40the opportunity to add anything further to their application to a maximum of 10 minutes.

7:46A chime will sound when there are 30 seconds left and another when the 10 minutes have elapsed.

7:52If you're the applicant and you have nothing for it to add, then you can just simply say so.

7:58Following this, some files may, staff may provide a brief presentation. The committee will then be

8:04able to ask questions to the applicant or staff. After that, we will hear from members of the

8:10public who wish to comment on an application. Please note that all comments should be addressed

8:16through the chair. Please avoid repeating concerns already stated by others and focus on adding

8:21new information. Comments are limited to 10 minutes or less. You will hear a chime when there are

8:2630 seconds left and another when the 10 minutes have elapsed. For delegates who have advised staff

8:37in advance of the hearing, they wish to display a presentation. Your presentation will be displayed

8:45on the screen and a remote is available at the podium for delegation in person to advance the

8:51slide. Any member of the public who have submitted a request to speak prior to the hearing will be

8:57first invited to provide comments. For those watching the hearing online, if you wish to speak

9:02to an application and have not yet submitted a request in advance of the hearing, please call

9:24Finally, as chair, I shall turn to the committee for emotion and deliberation, as well as a vote on

9:30the application. When the committee is making a decision on an application, the chair will be asking

9:36the secretary treasurer to conduct the vote by roll call. Our secretary treasurer will call each of

9:42the member's names and each member shall respond if they are in favor or opposed to emotion. And as

9:49chair, I will announce the result of the vote. If you wish to receive a copy of the decision

10:27At this point, we'll turn to member Fitzpatrick for our territorial acknowledgement. And if

10:35those that are able would please stand while it's being read. As we gather, let us take time to

10:46reflect on our privilege to live and work in Guelph, a city built over rich indigenous histories.

10:52We are guests here and we should reflect upon the responsibility to care for this land, the people

10:57who live here today and the generations to come. If our actions today can move us towards

11:02reconciliation, we should take pause and make those decisions with intention and gratitude.

11:08This place we call Guelph has served as traditional lands and a place of refuge for many peoples over

11:14time. But more specifically the Atawanda Ronque and the Haudenosaunee. This land is held as the

11:22treaty lands and territory with the Mississaugas of the Credit First Nation. Guelph lies directly

11:28adjacent to the Haldeman Tract and is part of a long-established traditional hunting ground

11:33for the six nations of the Grand River. Many First Nations, Inuit and Métis people who have come

11:40from across Turtle Island call Guelph home today. Thank you Member Fitzpatrick. Committee members,

11:56are there any disclosures of canary interest? Seeing none, I would like a member to move and

12:06second the minutes from our last meeting. Member Goodfellow and seconded by Member Fitzpatrick.

12:20I have confirmed with Secretary Treasurer that we do have a deferral request today and I'll turn

12:27it over to our Secretary Treasurer to address this request. Thank you Chair. For minor variance

12:34A93 slash 25 regarding 1861, 1871 and 1879 Gordon Street, staff is recommending deferral of the

12:44application to allow further zoning review through the site plan process to avoid the need for a

12:49further additional variance application. The agent has agreed to the deferral recommendation and is

12:54not present this evening so I'll turn it back to the Chair for a deferral motion. Thank you. Is the

14:22to permit increased height of existing fence in front yard at 113 Harris Street. I'll also note

14:47come forward to the podium. Good afternoon. Good afternoon. Can you state your name for the record

14:58please? Sandra Roncato. And your relationship to this application? I'm the homeowner. And can you

15:04tell me if the sign was placed as per the planning act? It was. I also submitted a photo to the committee.

15:11I love having that double

15:17address that makes it that much easier because sometimes at this time of year these signs do get

15:23lost. So as you may know if you heard in my preamble you have 10 minutes and you can make as much use

15:31of that time as you'd like. Thank you. The fence in question has been up since 2017. It's a sturdy

15:41wrought iron fence. It's in like new condition and it's cemented in. It hasn't been an issue with the

15:48snow removal or any injuries from passersby. It's far enough away from the sidewalk that it hasn't

15:56caused any issues. I put it up because people I have flower beds on my front yard and pedestrians

16:03tend to step all over the front, step all over my flowers and in the summertime. Also when they're

16:11walking their dogs it kind of deters them from doing their business on the grass which they most of

16:16them do not clean up. So that's the reason why I put the fence up. So I hope that the committee

16:23will see that they can will approve of the existing fence. It cost me $5,000 at the time plus the

16:31installation so it would be a lot of money wasted if the fence had to come down and like I said so

16:38far it hasn't been any issues with it. I haven't had any issues with the neighbor. It doesn't obstruct

16:42the view because it is wrought iron so you can see through the spindles. Thank you that's concise

16:48and to the point. I did neglect to ask if you had read the staff's comments and if you're in agreement.

16:57I didn't receive anything from written staff. No. Okay. If you want to wait right there

17:06my colleagues may have some questions for you. Committee members do we have any questions of

17:10this applicant? Yes. Member Meir. Yeah through you Jill I want to ask a question to the staff

17:22in the planning they are saying that they have no objection to wrought iron fence

17:30or an equivalent fence. So to me it is the sighting from outside which is important not the height

17:38from what I understand. So it is more important that as you are giving an option of equivalent

17:45fence tomorrow if it is substituted with wood planks or something is there a bylaw of equal

17:54spacing which determines the minimum spacing for the sighting from outside or anything?

18:07Did you catch that? Not quite. Member Meir perhaps you could restate for the

18:16I actually addressed it to the wrongly to the I wanted with the staff not the

18:23I got you. I got you. Okay. Sorry. I'm going to turn to staff and see if they have an answer for

18:29Member Meir. Through you Mr. Chair to Member Meir. So that's correct staff have no objection to

18:37the fence as it currently exists and the recommended condition was worded so that way in

18:43theory it could be rebuilt to be an equivalent fence that is also see-through so that way it

18:48doesn't obstruct any sight lines for vehicles or pedestrians. I don't believe there's any bylaw

18:54regulating specifically the width of the rods or the slats but that's something that would be

19:01reviewed if a new fence were to be built. Okay. Thanks. Thank you. Any other yes member Goodfell

19:11I guess through the chair to city staff so kind of to follow up on what Member Meir just asked

19:17like fences like these often tend to have climbing vines or other I guess vegetation that

19:24accumulates or grows on them is there any concern about that here where over time

19:30like the vines may grow and obstruct some of the the sight triangle in this case as well?

19:40I have a tree a magnolia tree planted next to it and then I have flower beds below it but the

19:46flowers are very they're like about two feet tall there is nothing climbing on the on the fence at

19:51all. Okay yes thank you and maybe just if I could just ask city staff to like in other circumstances

19:59understanding that maybe not in this one but over time is there has there been concerns like that

20:04that have come up in other situations? Through the chair to member Goodfellow

20:12when sight lines are viewed that aren't in compliance that is when our staff zoning inspector staff

20:20do go out and work with the homeowners to clear the obstruction but I think the owner is now aware

20:27that not to have any obstruction within that fence or have any plants growing on it.

20:32Those climbing vines they're very invasive and I've dealt with that before and it's they're very

20:36hard to kill if you're trying to remove them so I stay away from climbing vines all together.

20:43Okay wonderful thank you. Thank you. Any other questions? Through you Mr. Chair I think this is

20:51to city staff just about the condition and the condition is the requirement for an encroachment

20:56agreement with the city is am I understanding this correctly? Through the chair to member Spears

21:06this actually came to staff through an encroachment agreement request where zoning reviewed it and

21:13found that the fence in its location did require a minor variance to then complete the encroachment

21:23agreement process so I did not include that as a condition because it's already in the process.

21:32Okay then the recommendation was approval with condition and I'm just I'm having a hard time

21:38understanding what the condition is. There doesn't seem to be one that I can see. Yeah the condition was

21:46that it be the open-style wrought iron fence or an equivalent fence so that the

21:54sight line wasn't it was a planning condition. I can read it here that the fence in the front

21:59yard of the subject property shall remain an open-style wrought iron fence or an equivalent fence

22:04so as to ensure vehicular and pedestrian sight lines remain unobstructed to the satisfaction

22:10of the general manager of planning and building so just to remain to ensure that it remains open so

22:17people can see through it. That's great that helps and so I have a follow-up which is to the applicant

22:23now that you understand the condition the city wants to put on this application

22:28are you okay with that condition? Yes I am. So then we can okay that's sort of done thanks.

22:44Seeing none if you want to wait right there we may have members of the public who wish to speak to

24:57lot with one retained residential lot at 122 Metcalf Street. I'll note for those attending

25:24relationship to the application please. Jeff Buseman, Van Hurt and Sirvang representing the

25:29owner and tenant owner of the property. Thank you and can you tell me if the sign was posted as

25:34per the plan. Yes it was. And I assume that you have read staff's comments. Are you in agreement?

25:43Yes I've read them and I'm in agreement. Well as you know Mr. Buseman you have 10 minutes.

25:50If it's possible to have a severance sketch up on the screen while that's coming up just

26:19there we are. There we go. If you could zoom in a little bit yeah that's great. This property is on

26:25Metcalf Street and and you can see the large space to a building on the left side as you see it from

26:30the paper that's the shopping that's like a strip mall property at the corner of Metcalf

26:37and Aramasa so the property on the left as you faced from the paper is is a commercial property.

26:45This property is being split into two for two semis a pair of semis. The property is quite large

26:53for for this the minimum width requirement is seven and a half meters for each half in this

26:58case it's 10 meters and in fact I've been just talking with the the builder we're probably going

27:05to have narrower houses than these on this and and the backyard is going to be a little bit bigger

27:10than this. We just threw on the biggest footprint the footprint that until we had more more finer

27:18designs of what that house is going to look like. So the property is quite large relatively speaking

27:23for what zoning requires in terms of the width like I said 10 meters versus seven and a half

27:28and also the area being 406 square meters versus 270 or 230 square meters each so quite quite a bit

27:37larger. The front of the proposed dwelling is set up to be 11 meters from the back you can see

27:43it's about a meter meter and a half further back than it is now and the house on the left when you

27:49face it from the road that's number 120 on the right as you see it from the paper. This will allow

27:57up to five parking spots on each side because the driveway is five meters wide 11 meters deep and

28:03there's a garage. I think this is a great infill opportunity at a corner of a transition I'm

28:09going to call it transition type of property from the residential to the commercial I think this will

28:15be a good a good use for this parcel. Be happy to answer any questions or comments. Thank you.

28:23Thank you Mr. Buseman. Committee members do we have any questions of this applicant? I'm seeing

28:31none. Oh sorry member Ross. Through the chair I just want to confirm what you said about parking

28:39that there's the capacity for five on each property is that correct? That's right the

28:45driveway proposed driveway is five meters wide and a parking stall needs to be two and a half

28:50meters wide and the depth of this is 11 meters and and that will allow two stacked cars so basically

28:57four cars can park in front of the house as well as one in the garage. Thank you. Any other questions

29:05for the applicant? Yes member Mimbrano. Through you chair I wanted to ask you about the comments

29:13from staff about the neighbor and the issue with the fence. What are your plans on on that fence

29:21because apparently the location is not on the right place? Just to clarify that the comment on the

29:28fence I believe I unless I misread I saw it as a comment from one of the persons that rode in

29:35unless staff talked about it as well. If there's any issues with the fence they'll it will be replaced

29:44we did do a complete a survey of that fence and it's in fact it's a little bit on the

29:53right now it's inside the property that we're working with so in light of having large backyards

30:01we may not replace it but if it needs replacing it will be replaced. Thank you. Member Goodfell.

30:09Yes so I don't want to get ahead of the proceedings here but it's I think this question maybe for

30:18city staff there was mentioned in the comments about an existing catchment drain so sorry through

30:24the chair to city staff I think there may be a clarification that may be needed about what is in

30:31the rear yard of the property there and whether or not that raised any concerns and needed

30:37an additional condition. Member Goodfell through the chair

30:43as is typical there is an engineering condition recommended for a grading and drainage plan

30:48so what you're seeing on the screen right now is is not detailed design it is just a conceptual plan

30:54and I would presume that most applicants would prefer to defer the detailed design which takes time

31:01until after they know the committee's decision so the conditions will assure that we will get those

31:06details later and we can review them but but presently based on I have read the the

31:13correspondence and we don't have any indication on our records of what's there so we would expect

31:20the engineer who's trying to clear that condition to present those details to us but we are aware

31:24of them now through the correspondence. Okay fantastic and maybe just a follow-up question if I may

31:29so through the chair to staff again is there any concern about having enough space given the you

31:36know size of the development on this lot for stormwater management or you know other infrastructure?

31:46Again to member Goodfellow through the chair I did notice that as the applicant has mentioned that

31:52the conceptual building footprint here is just sort of representative of the largest possible

31:56footprint and not necessarily the the finished foundation footprint but I did notice on the

32:02conceptual drawing that the conceptual setbacks for the rear yard are seven and a half meters and

32:08this is a site that's located in the stormwater policy area 13 which typically would require that

32:15when you're increasing the imperviousness of the site that you would have to include some sort of

32:21low impact development stormwater features to compensate for an infiltration deficit

32:26and those need to go somewhere on the site typically that's in the backyard but with a seven and a

32:30half meter footprint it doesn't immediately excuse me with a seven and a half meter minimum conceptual

32:37rear yard setback it doesn't immediately raise concerns for not sufficient space typically they

32:43need to be set back a minimum of five meters from existing building foundations. Okay that really

32:50clears it up thank you. Any other questions for the applicant? Member Ross? My question is for staff.

33:00Okay thank you but before I go on I believe the applicant's representative had a comment or not I

33:07don't know about the previous question. It's up to you Mr. Chair it preliminary further design at

33:13this point has been looking at 8.7 meter rear yard and there is a catch basin there it's at the very

33:19back left hand corner when you face it from the road so it's not like it's right by the property

33:25corner that catch basin and so the plan preliminary plan is infiltration galleries monitoring wells

33:32have already been installed to understand the water tables and so on so that is the plan. I hope that helps.

33:42Through you a chair to staff so the one of the the comment letters referenced previous use a dry

33:51cleaning use also this property is adjacent to existing commercial and major roadways so my question

33:58is at what point in the planning building permit process is soil testing typically required and is

34:10that something that is entertained with this application or is that too early to to talk about

34:15that just yet? Through the chair to member Ross I want to be careful not to get too far into the

34:24environmental engineering questions and speak outside of my area of expertise but I do have a

34:29condition in there for environmental reporting and all environmental reporting has to be consistent

34:36with our guidelines for the development of contaminated or potentially contaminated sites

34:40that's our municipal guidelines. In those guidelines there's a series of report types that are I'm

34:46going to say increasing in in the amount of engineering that goes into them but depending on

34:54the reporting level of the first reports that are submitted you may or may not need to proceed

35:00to those other reports so for example for a site like this I believe that the guidelines would allow

35:06that to meet that condition to clear that condition they could I believe so but they'd want to verify

35:11for themselves I believe they can start with a site servicing questionnaire or excuse me a site

35:16screening questionnaire and what that is is that's a four page letter that's filled out by the applicant

35:22or their agent and it speaks into some degree about the past use of the property and actually in fact

35:28the first question is about whether or not previous use includes dry cleaning because I believe that

35:32was mentioned in the correspondence that site screening questionnaire has to be signed there's

35:38a declaration it has to be notarized by a public notary if the answers on the site screening questionnaire

35:44are sufficient that it doesn't need to proceed to further reporting such as a phase one environmental

35:49site assessment or phase two etc etc then then that would be enough to clear the condition

35:54if the answers are such that further reporting is needed then it could be that the testing that

36:00you're speaking to might be required as well but it depends on what the results are thank you

36:08Mr. Buseman you had your hand up so I'm going to I just to take it a step further our client has

36:14already taken the steps of doing the ESA phase one and two so that's kind of what's referred to and

36:20both and have come up clean so we've already it's already been looked at thank you thank you committee

36:29members any other questions of the applicant seeing none staff doesn't have a presentation do they

36:38on this no okay and are there any members of the public who would like to who have registered

38:48application for the record plate yep my name is Colin van der word van harten surveying and uh I'm

38:54the um agent thank you and can you tell me if the sign was posted as per the planning act it was yes

39:01um not to question your veracity but and given the weather it wasn't evident when I drove by today but

39:11we'll take your word for it given as I say the inclement weather over the last few days

39:16have you read staff's comments and are you in agreement uh yes I've read staff's comments

39:22and I am in agreement yeah okay um as your colleague has indicated or

39:30I have indicated to your colleague you have 10 minutes to address the committee thank you

39:37so this is a severance application we are proposing to split a portion of land that is

39:47within the municipal boundary of the city of Guelph from a agricultural portion of land that's in

39:52the township of Guelph Aramosa so the majority of the property is is in the township of Guelph

39:58Aramosa 29 hectares and um you know a small portion half a hectare is in the city of Guelph

40:10the current owner is a farmer and doesn't intend to do the development

40:15wants to maintain the farmland but wants to sell off or consider selling off the portion of land

40:21within the city of Guelph so um you know this is a bit of a technical severance for just

40:28you know updating the property lines to match you know the municipal boundaries

40:35so staff has supported this um any planning work there's no proposed development at this stage

40:42the idea is just to get this ready so somebody actually could go into the effort of

40:47evaluating a development in the future here our applicant is not proposing any development at

40:53this stage they just would like to split the land from the from the rest of the farm

41:01I don't think I'll I don't think I have anything else to add unless you guys have questions

41:06happy to answer thank you very much and if you want to wait right there my colleagues may have

41:11some questions for you committee members any questions of this applicant I have a question

41:19for staff and it may be a little esoteric and that is um why the funny jiggity jog with the

41:29city boundary that that would make this application necessary does anyone have an idea to the chair

41:42no I do not know why it cuts in like that

41:50it was more curiosity than anything else yes please if you have an answer I'd be interested to know

41:58Mr. Chair from my understanding from from looking at some of the reports

42:02in the past and talking to the owner the idea is there there's a shed in that portion portion of

42:09the property and that's why there's a zigzag and I guess when the municipal boundary is being

42:14expanded the thought was to be able to maintain that shed but the boundary was also done without

42:20any proper mapping so the shed actually is right along the municipal boundary so our applicant

42:27is going to have to remove the shed anyways so we actually did explore wanting to square it off

42:33we thought it'd be neater and tidier but with the municipal dealing with two municipalities

42:40the costs and time just weren't feasible

42:45understood thank you for the background it's appreciated thank you oh member ross

42:52through you mr. chair so just so I understand the drawing the septic

42:58uh and two sheds a well and an existing driveway are on the retained lands separate lands

43:09no retained lands is that correct so are are all of those um are some of those items necessary

43:19for the lot to function as a building lot or is that just uh something that would fall by the way

43:27aside in in the event that the new lot was redeveloped sorry I don't quite understand your

44:13few meetings looking at future development lands how does this fit in with the bigger picture for

44:22the rest of the land and at what point does that bigger chunk of the farm become part of the city

44:30of guelph versus and tying into all their services and be part of a bigger development scheme than

44:37what we've got before us uh through the chair to member fitzpatrick so the larger portion of

44:45lands is all located within the township of guelph aramosa and it's all zoned agricultural or

44:51natural heritage currently so there are no plans for future development or future development

44:56potential on those lands in theory that could change in the future but that's not something that is

45:03planned for at this time however the lands that are being severed that are within the city of guelph

45:08are zoned for low density residential and there is a holding provision on those lands to ensure that

45:14there is adequate servicing prior to any development taking place on those lands thank you welcome

48:07it's a two-story brick century home with an existing single story bump out addition to the rear

48:12yard there's also an existing deck on the rear yard we are seeking a side lot variance for both the

48:19deck and a proposed second story addition on the existing first floor bump out we have a letter of

48:28a letter in our favor from the neighbor adjacent to 12 tiffany street west who will be most impacted

48:34by the building of the second story addition and they have lent their support to the homeowner

48:40and this project moving forward i'm happy to open this up to any questions and that's all i have to

49:04conditions suggested by city staff did you have a chance to look at those and do you agree with them

49:14plan in place and the second was working with city bylaw to ensure access to both properties and

49:18both of those considerations are absolutely reasonable and we are happy to accommodate great thank you

49:25any other questions um could we have the um the site plan up again please um i'm just a little

49:38unclear what the what is it 33 or 0.33 meter diameter and the 0.22 meter diameter is

49:49those are the existing setbacks from the existing structure so the existing

49:54single story rear bump out is currently 0.33 meters from the neighbor's property line

50:00and the existing rear deck is also 0.33 meters from the side property line and 0.22 meters from

50:07the existing rear property line okay it's it's just when i saw the diameter symbol it confused me
