0:24Good afternoon, Guelph, and I'd like to call to order the May 9th, 2024 hearing of the Guelph
0:30Committee of Adjustment. This hearing is being held in a hybrid format with attendees appearing in
0:36person and or remotely and is being live-streamed and recorded. Please be advised that public hearings
0:43form part of the public record and the words, names, and images of those participating shall be
0:49recorded and posted online. Before I outline the hearing format, if you do wish to speak to an
0:56application that's listed on the agenda and have not yet submitted a request in advance of the
1:03hearing, please call the number displayed now on the screen, which is 519-822-1260, extension 2524.
1:14That's 519-822-1260, extension 2524, and you shall receive instructions on how to participate.
1:24A final call for delegations will be made when each application is called. The agenda for this
1:30hearing has been posted online at guelph.ca forward slash c-o-f-a. I will remind all committee members
1:40and staff participating in this hearing to please unmute your microphones when not in use.
1:47Applicants will be unmuted when their application is called. I'd also like to share the hearing
1:54format we will be using to navigate through each application. Each applicant will be called by the
2:00secretary-treasurer and the call-in number for those wishing to speak to an application will
2:05be displayed on the screen. Afterwards, the applicant will be given an opportunity to add
2:12anything further to their application to a maximum of 10 minutes. You will hear a chime when there
2:18are 30 seconds left and another when the 10 minutes have expired. If you are the applicant and have
2:25nothing further to add, you can simply say that you have nothing further to add. The committee
2:32will then be asked to question the applicant or staff. After that, we will hear from members of
2:38the public who wish to comment on the application. Please note that all comments should be addressed
2:45through myself the chair. Please avoid repeating any concerns already stated by others and focus
2:52on adding new information. Comments are limited to 10 minutes or less. You will hear a chime
2:59when there are 30 seconds left and another when the 10 minutes have elapsed. Any members of the
3:05public who have submitted a request to speak prior to the hearing will be first invited to
3:12provide comments. For those watching the hearing online, if you wish to speak to an application
3:18and have not yet submitted a request in advance of the hearing, please call the number displayed
3:23on the screen now. For those attending the hearing in person, you will also be given a chance to come
3:29forward to the podium and address the committee. Once all comments from the public have been heard,
3:36the applicant or staff will be given opportunity to respond to the comments. Finally, I shall
3:42turn to the committee with a form of motion and a liberation and then a vote on the application.
3:49When the committee is making a decision on an application, the chair will be asking the
3:54secretary treasurer to conduct a vote by roll call. The secretary treasurer will call each
4:00member's name and the member will respond if they are in favor or opposed to the motion
4:06and the chair will announce the result of the vote. If you wish to receive a copy of the decision

4:59take time to reflect on our privilege to live and work in Guelph, a city built over rich indigenous
5:05histories. We are guests here. We should reflect upon the responsibility to care for the land,
5:09the people who live here today, and the generations to come. If our actions today can move us towards
5:15reconciliation, we should take pause and make those decisions with intention and gratitude.
5:20This place we call Guelph has served as traditional lands and a place of refuge for many peoples over
5:25time, but more specifically, the Adua Darank and the Haudenosaunee. This land is held as the treaty
5:32lands and territory with the Mississaugas of the Credit First Nation. Guelph lies directly adjacent
5:38to the Haldeman tract and is part of a long established traditional hunting ground for the
5:43six nations of the Grand River. Many First Nations, Inuit, and Métis people who have come from across
5:49Turtle Island call Guelph home today. Thank you, member Siegel. Committee members, I would like

6:56order to address the concerns from the Grand River Conservation Authority, as outlined in the staff
7:02comments. The agent has advised that they won't be in attendance this evening, so I'll turn it over

9:51hear you. My name is Catherine Kirkland. And can you state your relationship to the application?
10:15I am a co-owner of the property at 9 Webster Street. Thank you. And can you tell me if the sign
10:24was posted as for the Planning Act? Yes, we are a corner property, so there are two signs, and they
10:31were posted a week ago Monday, one on each of the streets that the property is facing.
10:39Thank you. So you have 10 minutes to make your presentation, and you can take as much or as
10:47little time of that as you'd like. All right. Thank you. We moved in about 10 years ago,
10:55and we put a shed in the property, and we did not realize that corner properties have different
11:02rules than regular properties. And we used the typical variance of the 0.6 meters, and it was
11:12only recently in February when we acquired a small three-person hot tub and applied for a permit
11:20when the sketch revealed that the shed was not where it should be. And in that time, we had planted
11:27a few other things, and the property is not very big, so there isn't really another place for the
11:42shed, unfortunately. So we were hoping to get a variance so that we did not have to move the shed.
11:50And we received recommendations from the city with conditions to say that the shed
12:01not used for human habitation, and that the structure, the variance only applies to the
12:07shed, and that all makes perfect sense. So yeah, I think that's it. But if anyone has any questions,

15:27Weatherson. And can you tell me if the sign was posted as per the Planning Act? We live on a corner
15:34also. We had two signs, one on each street. And have you read staff's comments and are you in agreement?
15:42I'm sorry? Have you read the staff's comments? About the recommendations? Yes. Yeah, they said
15:50everything was okay. Sorry. Thank you. We have 10 minutes to address the committee if you'd like to
15:56make time. Okay. Well, we've lived there for 25 years. There's been an accessory apartment upstairs,
16:02which we want to turn into part of the home and invite our in-laws to move in on the first floor,
16:08my in-laws. So it's an extended family situation. Most of the variances are for existing buildings.
16:17It's a very old house. And it's close to the street because the city has moved sidewalks and such
16:24over time. So the carport is sort of in line with the house. We wanted to do it so that the
16:32house looks like it doesn't have an addition. It looks like an actual home. Over the years,
16:36people have added things to the house that don't fit. So we're going to turn the one and a half
16:41story into a two-story. So it looks like a proper home that fits in with the neighborhood. I think
16:47that's everything for today. Thank you. If you want to overweight right there, my colleagues may
16:52have some questions for you. Committee members, do we have any questions of this applicant?
17:00Yes, members, Pierce. Yeah, to the applicant through you, Mr. Chair, I just want to make sure
17:05when you said that the city said everything was okay, there is a document with the conditions
17:10recommended by the city to go with your application. And I just want to be sure you're aware of those
17:15conditions. It sounds like perhaps you didn't see them. No, I did read it over. The conditions were,
17:21what I understood was that the building is existing so that I had to, I couldn't project out any
17:27further. Am I mistaken? There's four recommendations here. One from Planning Services,
17:34one Engineering Services, one Building Services, and one Electro Utilities. Yeah. And when we do go,
17:41if we go forward with this and move to approve the application, it will be with those conditions.
17:46And I want to be sure that you're, that you understand the conditions and you agree with them.
17:51I think I understand all the conditions. Most of it had to be done because of the building,
17:56like the electrical, had to be moved and such. Okay. Yeah. Great. That's all I wanted to be sure of.

20:02The next and final application is file A-25-24, variance to permit increased gross floor area
20:16for commercial entertainment and restaurant uses at 219 Silver Creek Parkway, Silver Creek Parkway
20:22North and 292 Speedvale Avenue West. I'll note for those attending remotely, if you wish to speak
20:28to this application, you can do so by calling the number displayed on the screen. That's 519-822-1260

20:40remotely. Is the applicant here? Yes. Please come forward. Good afternoon. Can you state your
20:57name for the record, please? Julian Smith. And your relationship to this application? I'm the agent.
21:06Thank you. And was the sign posted as per the planning act? Yes. It's also a corner property,
21:13so two signs are posted. Great. And can you tell me if you've read staff's comments and if you're
21:20in agreement? Yes, I read the staff report and we are in agreement. We have 10 minutes. So avail
21:28yourself to as much or as little of that as you'd like. Thank you. So this is a variance to the new
21:37zoning bylaw, which places a restriction on the amount of ground floor area that can be used for
21:44restaurant or commercial entertainment use. It restricts it to 500 meters squared. And at present,
21:51the property is over that. It also restricts any future restaurants from coming onto the property.
22:00So this is strictly being done in order to address any future businesses that want to come to the
22:06property. We're proposing that the ground floor area be adjusted to 30% for restaurant and commercial
22:14entertainment use. And that 30% is based on surrounding lands that have that same restriction.
22:25The surrounding lands range from about 20 to 50% of the lots having restaurant uses. So what we're
22:34proposing at 30% is consistent with surrounding lands. There's no changes to the site. There's no
22:41development. The buildings will stay as is. This is just strictly to adjust for vacant units on the
22:48property that may want to accommodate future restaurants. Thank you. That's very concise. If
22:55you want to wait right there, my colleagues may have some questions for you. Committee members,

23:09Yes, actually, through the chair to the applicant. My question is about the other comparable
23:14properties that you evaluated. I did take a look. I understand that, yes, they are all
23:20similar in some ways, but they're all much smaller. I guess were there other locations that you
23:26evaluated that were of an approximately the same similar size? Because I think I'm just trying to
23:35reconcile in my head the 30% 500 square feet, square meters at 30% is quite a bit different than 1800
23:46at 30%. So just trying to understand if you had looked at some other properties as well. Thank you.
23:54Yeah, through the chair, we did not look at other properties. The property itself is quite large.
24:02It's two hectares in size, which is much larger than the properties that we were looking at.
24:08So when you compare a smaller property with more coverage versus a bigger property with less coverage,
24:15you're bound to have less space dedicated to restaurant use. So we didn't think it was necessary
24:22to look at other properties. Thank you. Was that it member Goodfellow? I believe it is. Member,

24:44Are the vacant units already designated for ICI use? Sorry for the restaurant,
24:52like is the original design of them for the restaurant use?
24:55It depends because this is a it's a commercial site or commercial plaza and tenants come and go.
25:03So they can alter the units per the use. I don't know exactly what function the
25:11the vacant units were previously, but I do know that they can be adapted to the use that comes in.
25:19Okay. Yeah, so they were and ICI's industrial commercial institutionals, they were in that
25:25realm of use anyways. Okay. Thank you. Are there any other questions of the applicant?
25:37I do have a question and I think it's more to staff. In touring the site, I don't necessarily
25:48have an issue with what's being proposed, but I do note that some of the units are
25:56relatively close to the fence line of the townhouses at 261 Silver Creek, although they are
26:03the rear of those units and it's it's perhaps a quiet spot there now, but we're a restaurant to go in
26:16and decide that they want they want to reverse the frontage and have it at at the back.
26:24It might impact the residents of 261 Silver Creek and I'm curious if there's some way that we could
26:38nip that in the bud. I don't want to be zoning by other methods, but I'm just wondering if there's
26:47some condition and it would also depend on whether or not the applicant was okay with this of
26:54making sure that the the rear of the property, I believe it's on Speedvale, could not be
27:05could not be reversed so that the front of the restaurant and and any associated noise would
27:11continue to be on the into the court rather than projecting into the into the neighboring properties.
27:21I'm struggling. Can you help me? Perhaps while you're having that discussion, I'll ask the
27:44proponent would that be an issue as far as your clients are concerned? My my my thought is to
27:51restrict any noise associated with a restaurant or a bar from projecting back into the neighborhood
27:59and so I was hoping we could come up with some words that would say that a restaurant
28:07would not have its frontage open to the to the rear of the unit. If I follow you correctly,
28:17you're saying the back of the property where that building is, it's an L shaped building
28:22having some kind of restriction on the type of uses that could go there? I'm not suggesting any sort of
28:32suggesting anything as for use. However, were we to say okay 30% of this development could be
28:43restaurant perhaps? Oh thank you. There are two as you can see them vacant spots between Burnside
28:52and another office on the bottom right hand corner of this plan. Were those to be combined into one
29:02restaurant slash bar and their entertainment to be part of that bar's business model?
29:13Potentially now they could have the garage doors open to the back and music could
29:21or dancing or smoking outside or whatever could could filter out into the neighborhood and I'm
29:28wondering if if if we said something to the effect that the rear could not be used in that fashion
29:40if that would be something that you could go along with?
29:42I would say that I don't think it's necessary that part of this site has historically been for
29:53offices and there's been some long-time office tenants in that part of the part of the site.
29:59As you can see the restaurants kind of cluster at the front that would be more ideal for a
30:05restaurant to be because it's more visible and easily accessible and then that long skinny building
30:10more the retail. I don't think it's necessary but
30:18and I also don't think that anything that went in there would back on to the residential property
30:25but if that's a condition that you want to impose I would I guess that could be reasonable
30:34if we are restricting any rear-facing uses. Okay thanks thanks for your opinion.
30:42Yeah. Do you have a chair just to speak to zoning?
30:48A nightclub is a permitted use in the MUC zone but when it does a but a residential property
30:55which this does the nightclub use or brewery or distillery use is not permitted on the lot
31:04so that could alleviate the nightclub use not the restaurant use.
31:08Outdoor patios are not permitted adjacent to the residential zone. Thank you for that so my
31:19grappling with this is more or less mute so thank you for that I do appreciate it so I'm not going
31:25to pursue this any further. Yes member Malamud. Through the chair to either the staff or the
31:33applicant I don't see anything with respect to parking in the in the staff report and is there a
31:41difference with respect to parking for restaurants versus other retail and would that much more
31:53restaurant going on the site impact the number of parking spaces that are currently on the site?
32:44Through the chair to member Balaban it's a multi-unit building and when a multi-unit building has
32:51multiple commercial uses within it it does have just a standard parking ratio. Let me just I just
32:59want to confirm oh but there is a note where a restaurant or a nightclub use occupies more than
33:0630% of the gross floor area of the multi-unit building then additional parking does need to be
33:15required for the restaurant use but this is right at 30% so we are okay. Thank you for that.
33:27Thank you good discussion. Are there any oh yes member Goodfellow. Yes thank you chair. This is
33:37discussion has prompted another question. I appreciated through the chair to the city
33:42staff I appreciate the comments about restaurants. I also noticed that commercial entertainment would
33:47be a permitted use under this new this change and can you just comment on whether your earlier
33:55comments about openings and residential and locations relative to residential are the same
34:02for commercial entertainment as for the restaurants? Yeah through the chair the commercial outdoor
34:16patios apply to every use if it's related to a restaurant or any other use and commercial
34:26entertainment I like to think of those as like escape rooms. What else do we see for commercial
34:33entertainment uses billiards but yes like the outdoor patio is for all uses not just a restaurant
34:43use like adjacent to residential it's restricted. Okay yes through the chair to the city staff thank
34:50you that's helpful and your comment about what would be included in that category is also helpful
34:55because I wasn't sure what types of establishments normally see under that under that heading so
35:02thank you I appreciate that. Thank you any other questions of this applicant we're still on the
35:10question phase seeing none committee members oh before I jump to committee members are there any
35:21members of the public either in the gallery yes please come forward. It's on okay my name's Lisa
35:43McWinney honorable chair and I live on Willow Road which is close to Silver Creek and I walk in that
35:49neighborhood frequently I have a number of safety concerns about this particular applicant's
35:56reasoning for the application there's a few of them so I did walk by late at night one night and
36:03the place was packed full of standing people so if I understand it's not delegated or approved for
36:12nightclub use that's definitely what it appeared to be there didn't appear to be any tables it
36:18seemed to be packed to pack wall to wall with standing people also the name on the business
36:24has already been changed although I understand the application was made from 360 was it ma'am
36:31it was made by 360 Silver Creek was it? The applicant will answer your questions. Oh sorry sorry sorry
36:40just so you're aware the process is that you can make comments and you can post questions
36:47but it's not a discussion at the point. Okay sorry I just I'm just asking for clarification of the
36:52name of the applicant. Can I when I ask who the clarification of the applicant's name sir
37:04I just I'm just asking the the applicant's name that applied for the zoning change or the
37:12change in floor space. The applicant is for two the owners of of the whole property.

37:37Through the chair so this is an application so the subject property is 219 Silver Creek Parkway
37:41North and 292 Speedvale Avenue West the owner's name is RML Corporation. Okay and the agent is
37:49appearing before us. Okay so I did notice that the name hit change had already been made I don't
37:54know if that was done legally. I have other safety concerns in the sense that I believe on the first
38:02night of opening there was a violent attack at that bar or I call it a bar now so that's a concern
38:09at this time so I'm wondering whether there's proper security. I'm wondering also if the liquor
38:16license is being adhered to in the sense I believe there's supposed to be a menu if liquor is to
38:22be served and I know some restaurants try to get around it by serving you know less than menu items
38:31that's a concern so if there's violence there on the first night then my concern is that at this
38:36time I would like it. I'm just going to stop you for a little bit we're not the licensing board
38:41we're not liquor licensing and the premise of this is whether or not we can allow expanded
38:49restaurant use so if you'd like to keep your comments to that. I guess the reason I'm making it
38:57sir is because if that particular restaurant is making the application my forward thinking is that
39:02particular owner expects to expand into other areas to open a similar so if he's already holding
39:09events he or she or they are already holding events that are not appropriate for that location and
39:15already having violence I would like to see it deferred until some of these so that they're
39:20bouncing is so their security is properly in place that their liquor license is properly in place
39:26before we start giving them permission to expand into other areas especially backed on to a residential
39:34neighborhood and other things so that's just my concerns or it like it's like I said it was it was
39:39packed to pack people I've also noticed an increase in women's clothing lying around the property
39:46after events so that's all I'm not naive sir I know what goes on in bars and that I've been in that
39:51restaurant bar when it was owned by other people and it was legit tables restaurants pool table
39:58but that's not what I saw that day so like I said sir my forward thinking is if the applicants asking
40:04this early on then they already have pre-plans to open similar things in that plaza and that's my
40:12concern right like if they're already not or perhaps not doing things right then that's only
40:18going to snowball you know and it might be harder to reel them in and and remove the permission
40:23than it would be to just have some safety concerns looked at prior to granting it like just a little
40:30bit more supervision would would be my concern like I said considering there are children and
40:37you know the people behind them yeah that would be my concern so thank you for allowing me to speak
40:44oh you're welcome and if you want to stand by I believe the owner is on the line and
40:52may be able to answer some of your questions so thank you very much for your presentation thank

42:22oversee a lot of our commercial properties as far as leasing thank you and I I'm sure you've heard
42:29some of the issues that have been raised and I wonder if you could respond to them yes I'm I'm
42:35not sure exactly what they're pertaining to um this is an application all the obviously by us as
42:42the owners of the property uh we have many tendencies on this property it's at a corner
42:48where there's commercial on all four corners and we are looking to do some more restaurant uses
42:55and as a member of staff was stating uses that are commercial entertainment which are
43:00becoming quite popular such as you know golf simulators is another example to escape rooms
43:06and there's very limited restaurants there's Papa John's we've got a wonderful cafe called
43:12Puffle Puffle Cafe at the owner or at the corner if no one's been there it's absolutely fabulous
43:17so we have some very strong commercial tenants there I can't comment on these other
43:21comments that were made I'm unaware of them I'm not sure what they're recording
43:25we have an actual excellent property management department within our company
43:30so I'll relay them but I'm completely unaware of them I'm not sure what they're recording or
43:34if they're in regard to a particular tenant they sound very unfamiliar to me thank you

45:45the appeal regarding the committee's decision to approve file a 1624 which was for 1859 Victoria
45:54Road south at the March 14th 2024 hearing has now been withdrawn so the committee's decision to
46:01approve the application is now final so that's the only announcement I have Mr. Chair thank you
