0:49Good afternoon. As this is the first hearing of the new term of the committee,

0:53I'll be acting chair for the first part of the hearing until the election of the chair and vice chair positions have been completed.

1:00So I'd like to call to order the January 11th,

1:082024 hearing of the Guelph Committee of Adjustment.

1:11This hearing is being held in a hybrid format with attendees appearing in person or remotely and is being live streamed and recorded.

1:19Please be advised that public hearings form part of the public record

1:24and the words, names or images of those participating will be recorded and posted online.

1:29Regrets have been received from member good fellow who will not be in attendance today and there is quorum to proceed.

1:35Before I outline the hearing format, if you wish to speak to an application that's listed on the agenda and have not submitted a request in advance of this hearing,

1:44please call the number displayed on the screen now, which is 519-822-1260 extension 2524 and you will receive instructions on how to participate.

1:56A final call for delegations will be made when each application is called.

2:01The agenda for this hearing has been hosted online at guelph.ca forward slash c o f a.

2:09I will remind all committee members and staff participating in the hearing to please mute your microphones when not in use.

2:15Applicants will be unmuted when their application is called.

2:19I'd also like to share the hearing format we will be using to navigate through each application.

2:24Each application will be called by the secretary treasure and the call in number for those wishing to speak to an application will be displayed on the screen.

2:32Afterwards, the applicant will be given an opportunity to add anything further to their application to a maximum of 10 minutes.

2:39You will hear a chime when there's 30 seconds left and another one 10 minutes has elapsed.

2:45If you are an applicant and have nothing further to add, then you can simply say so.

2:50The committee will then be able to ask questions to the applicant or staff.

2:55After that, we will hear from members of the public who wish to comment on the application.

2:59Please note that all comments should be addressed through the chair.

3:02Please avoid repeating concerns already stated by others and focus on adding new information.

3:09Comments are limited to 10 minutes or less.

3:11You will hear a chime when there is 30 seconds left and another one that 10 minutes has elapsed.

3:17Any members of the public who have submitted a request to speak prior to the hearing will be the first involved to provide comments.

3:24For those watching the hearing online, if you wish to speak to an application and have not submitted a request in advance of the hearing,

3:34For those attending the hearing in person, you will also be given a chance to come forward to the podium and address the committee.

3:41Once all the comments from the public have been heard, the applicant or staff will be given the opportunity to respond to comments.

3:48Finally, the chair will turn to the committee for a motion and deliberation as well as a vote on the application.

3:53When the committee is making a decision on an application, the chair will be asking the secretary treasurer to conduct the vote by roll call.

4:01The secretary treasurer will call each of the members' names and each member will respond if they are in favor or opposed to the motion

4:07and the chair will announce the result of the vote.

4:52As we gather, let us take time to reflect on our privilege to live and work in Guelph, a city built over rich indigenous histories.

5:01We are guests here and

5:03we should reflect upon the responsibility

5:07to care for this land, the people who live here today, and the generations to come.

5:12If our actions today can move us towards reconciliation, we should take pause and make these decisions with intention and gratitude.

5:22This place we call Guelph has served as

5:25traditional lands and a place of refuge for many peoples over time, but more specifically

5:31the Atawanda Rang and the Haudenosaunee.

5:35This land is held as treaty lands and territory with the Mississaugas of the Credit First Nations.

5:42Guelph lies directly adjacent to the Haldeman track and is part of the long

5:47long established traditional hunting ground for the six nations of the Grand River.

5:52Many First Nations, Inuit and Métis peoples who have come from across Turtle Island

5:59call Guelph home today.

6:04Thank you member Balaban. The next item on the agenda is the annual election of the chair and vice chair for 2024.

6:12At this time, I'd like to invite a motion from the floor to appoint a member as the 2024 chair effective immediately.

9:10Yes, I'm an employee of Metrolinks and Metrolinks has submitted

9:17comments and submissions on

9:20some files today. So I wanted to declare that and recuse myself from

9:25a consideration of those files.

11:03First, there were two applications that were listed under the deferral section of the revised agenda.

11:09That first one is deferral of file A-4 slash 24 for 22 Neve Street to allow the applicant to address the non-compliant exterior

11:20side yard setback.

11:21And I believe the owners are in attendance this evening via video.

11:49And have you read staff's comments regarding the deferral and are you in agreement?

12:04I don't think we got an email with any comments.

12:10Staff has recommended that your application be deferred to a later date. Are you in agreement?

12:18What are the implications of the deferral?

12:27That we would not be hearing your application at this meeting and that you could come back to a later meeting once the

12:36you have met with city staff or had conversations with city staff and have gone forward

12:44and want to come back at a later date.

12:47Which city staff would we have to talk with?

12:58Well, generally speaking it would be whomever you've been speaking with

13:06at the planning department or the building department.

13:10Have you had conversations with city staff?

13:13Yeah, we've met with the planning department over the past few months

13:20to go through this application.

13:25And I guess this has put me a little bit on my back foot. Generally a deferral is

13:34the applicant has either considered the deferral and wants to go forward or accepts

13:42staff's recommendations that we do defer the application. So I'm a little unclear how we're

13:48going to proceed. Are you saying that you do not want a deferral?

13:57No, we don't want to defer this.

14:00I don't understand the options so it sounds like we have to defer.

14:08If you just give me one moment to confer with our secretary, treasurer.

14:12Chair Smith, if I might add, so there was an email circulated to applicants last Friday

14:18with a copy of the comments that staff had provided. So you would have received an email

14:23with the staff comments. If you didn't receive that we can certainly make sure that

14:27you have that information. But what I would maybe suggest if you didn't

14:33receive that in advance is that we kind of proceed to go forward. You can ask, usually the

14:38applicant has 10 minutes to speak to the committee. So if you have some questions,

14:41perhaps staff can maybe further address the reasons for deferral. There was a missing

14:46variance that was identified, but we can go into some further explanation on that.

14:53Thank you, Madam Secretary Treasurer. I believe that Ms. Pencer has some more information.

15:00Yeah, through the chair and just to the applicants, at the review of the minor variance drawing,

15:05an additional variance was required for an exterior side yard setback. It's under,

15:12unfortunately, the 1995 zoning bylaw and that wasn't captured. So if you moved forward with

15:19this variance application tonight, there were no concerns with the variance that was requested,

15:26but it's still missing one variance that would need to be approved to move forward with the

15:33building permit. So I'll just continue. So a deferral would just allow you to add that variance

15:44and then come back next meeting. I see. Okay. Thank you. Yeah. Sorry, I was confused what the

15:50deferral meant. Yeah. Thank you. And yeah, if we could get that email, please. We never received that.

16:01So it, first of all, it sounds like you didn't see the email that was sent

16:09and our Secretary Treasurer has confirmed it was sent. So perhaps there may have been

16:15in some glitch somewhere. However, did you understand what city staff were just saying now that

16:26your drawings only encapsulate, it sounds like, one part of the variance and that you would have

16:32to come back with the second. So a very, pardon me, a deferral would mean that you'd be able to

16:37capture all of this and only come back once and not have to address it today. And then a subsequent

16:43meeting. Do you understand that? Yeah. Yeah, that makes sense. So I'll circle back and ask if you

16:52are in agreement for a deferral. Yes, we're in agreement. Okay. I'm glad we were able to clear

17:00that up. So committee members, I'm looking for motion. I move that file a-4-24 be deferred.

18:30The staff is recommending deferral in order to allow the applicant time to clarify their

18:35proposal and meet with staff and address the condominium approval. There also was correspondence

18:41received after the comment deadline from the agent of the application supporting the deferral

18:46recommendation and that correspondence has been circulated to the committee members and staff.

18:52I also have been advised that the agent will not be in attendance this evening.

19:00So there is no applicant or agent in attendance, so we will move right and given their late

19:09comments that they were in agreement with the deferral, we'll go right into that.

19:15So I'm looking to my colleagues for a motion. I move that we accept the deferral request on this file.

24:07The first application is file B-1-23, consent to create one new industrial lot with one retained

24:15industrial lot at 280 Speedvale Avenue West. I'll also note that for those watching online,

24:22if you wish to speak to this application, you can do so by calling the number displayed on the

25:17Erich Burles, LLP. And I do apologize. I'm glad you can hear me because I seem to be having

25:24a little bit of an issue with my video, which if I can just take one more moment, hopefully.

25:31Ah, there. Can you see me? We can see you and hear you. So our technology is

25:41making leaps and bounds. It bodes well for 2024, Mr. Chairman.

25:48So I need to ask you if the sign was posted as per the Planning Act. It was, Mr. Chairman.

25:55Thank you. And you have 10 minutes to address the committee if you would like to make use of that.

26:02Thank you very much. I won't take the full 10. I'll just provide some brief remarks. Mr. Chairman,

26:08I'm here on behalf of Linnemar Corporation, which is an established, well-established and

26:13long-standing industrial and employment operator in the municipality. The site, which is the subject

26:20of this application, is currently used by Traxel, which is a division of Linnemar,

26:24which specializes in the manufacture of high-quality automotive parts. The purpose of this application,

26:30Mr. Chairman, is to optimize these existing lands, which are designated and zoned for employment

26:36purposes, by severing what is a vacant and underutilized portion of the property.

26:41And that is shown as the conveyed lot or part one in the application that is before you,

26:47to allow for a future development opportunity. It's important to note that there are no changes

26:51proposed to the existing building, the existing parking configurations, the existing access to

26:58the site, all of which comply with the City of Guelph's zoning permissions. And it's also

27:05important to note that the resulting lot, which would be the part one lot to be severed in the

27:10application, also complies with the City of Guelph's zoning regulations as it relates to

27:16frontage lot area and those other important requirements. I've had an opportunity to review

27:22with my client the January 11th, 2024 staff report. And I commend that report and that

27:30staff recommendation, which is to allow this consent in that it meets the criteria pursuant

27:36to the City of Guelph's official plan and also pursuant to Section 51 of the Planning Act as

27:42it relates to a consent to sever in lieu of a subdivision and staff's recommendation that it

27:48ought to be approved with conditions. I've reviewed with my client and its consultants the conditions

27:55which are set out. I would note that it was identified that there is a variance to the new

28:02City of Guelph's zoning bylaw, the new comprehensive City of Guelph, which is to recognize the existing

28:09landscape buffer on the site. City Planning staff have asked that as a condition of a final

28:15certificate of official for this consent that our client apply for and obtain the variance to

28:21legalize that existing condition. And I can advise the committee that we have already filed that

28:25minor variance application, but can also confirm that we agree to that condition. There were also

28:31a series of conditions from engineering services that are itemized at numbers two through five

28:37on the first and second page of the staff report that's before you. Those all relate to

28:42appropriate conditions related to site grading and servicing and confirming some of those details

28:48with engineering staff. And again, our client consents to those conditions, Mr. Chairman. I

28:53finally just wanted to address for the benefit of the neighbor who did write in, and out of respect

29:00for that neighbor, you'll see there's correspondence in your file, Mr. Chairman, from an area resident.

29:06I won't name the individual. There's no need to, as this is a public hearing, who asked some questions

29:14with respect to how the site that is being created will be used. It is the intention, as is set out

29:20in our application, that this be a future development site for uses that are permitted in the zoning

29:26bylaw. And that would of course be the subject of an application that would go through the city's

29:30process. There is no use intended at as of today. There are questions related to lights, and I can

29:38just share with the committee that there were lights on the existing facility which were actually

29:43stolen, which is odd to me, but did occur, and those lights were recently reinstalled. Our client

29:49has asked the facilities manager for the site to go out and inspect those lights and understand if

29:54they are either brighter than they need to be or have been misdirected to the neighbor's property.

30:01So we're going to undertake a review of that and thank the adjacent neighbor for identifying that

30:07for us. I would note though that I don't think either of those comments pertain to the appropriateness

30:13of the consent application that's before the committee. Other than that, I just wanted on

30:17behalf of our office and our client to thank engineering staff and planning staff at the

30:22City of Guelph. They've been very gracious and helpful as we've moved through these applications,

30:26and I wanted to acknowledge that. Thank you very much, Mr. Chairman.

33:22agent for this application on behalf of Paul and Helen, who are seated behind me here.

33:29Thank you. And can you tell me if the sign was posted as per the Planning Act?

33:34They both were, actually. Yes, in this case. Awesome. In that case, you have 10 minutes to

33:41address the committee. Thank you. And I don't expect to take 10 minutes for this either. I just

33:48briefly describe it. I think you'll recall we had this deferred from the previous month's application

33:55roster. There were a number of questions from staff, planning and engineering staff, prior to that

34:01meeting, which made sense because it was it's it's a fairly involved application. And I'm very happy

34:09to say we worked through those with staff in conjunction with the owners. There was there were

34:14a number of adjustments made on the applications and reapplication of drawings and submissions.

34:20And in general, I'd say we're quite quite pleased with the outcome of that that exercise and the

34:27deferral efforts that went into that. And the comments received all make good sense. Quite

34:34acceptable to us. So yeah, I think the only I did have a question that came from that. And I'm

34:40apologize. I probably could have put it through to the committee a few days ago. And it's just in

34:45regard to the Metrolinx comments that were included. As I see, there's there's a number of conditions

34:52suggested by engineering prior to building permit, which we had discussed and made sense. I'm just

34:58wanted to make clear that I understand the Metrolinx comments as I I took them to be there.

35:03The really advisory comments on behalf of Metrolinx for future work that might occur. But there

35:11isn't any sort of immediate requirement with this application to satisfy a Metrolinx condition. I

35:16I think that's that's how it reads. But I'm hoping staff, some staff can explain,

35:21confirm that that is in fact the intent of those comments.

35:27Um, normally we break at this point for for comments from the public, but perhaps given

35:35your statement, I could diverge a little bit and ask if staff could answer your question.

35:46Absolutely. Through you, Mr. Chair, I think Mr. Grinum's understanding is correct. The

35:51Metrolinx comments are listed as advisory comments and don't recommend any conditions for the

35:57application. As such, they are just comments and no additional conditions are recommended.

44:12324 square meters and with a frontage of approximately 8.3 meters onto Yorkshire street

44:18And there is an existing 1.5

44:22Story house on the site currently

44:24Next steps, please next slide, please

44:27So our proposed development just seeks to maximize this residential lot

44:32It's a very narrow lot and by removing the existing dwelling and reutilizing the site to allow for two-story residential building

44:40So the the development basically seeks to maintain a similar building footprint as the existing residential dwelling

44:48As such minimal disturbance to the subject site is expected

44:54The proposed development is compatible with the uses currently permitted under the existing and proposed zoning bylaw

45:03Including one and two

45:05Family dwellings this type of dwelling form is consistent with what is found in the general area of the subject site

45:12And next slide, please

45:14So in order to ensure an appropriate development some minor variances are being requested

45:19Which are the subject of our application tonight

45:22And these include a minimum front yard setback of two meters from the proposed dwelling

45:27A minimum right to a side yard setback of 0.47

57:18A lot of people which is really sad to say and it breaks my heart of unfortunate people that we should care about and and whatever

57:27When it comes to shelters and stuff and that I think there should be a little bit more explained in here about how things would um, um

57:36Operate if this was approved and I also have a question

57:41Um, who is the applicant? Is it a private person? Is it um

57:47Run by the government. Is it provincial funded? Those are very important things. I think that the public should know

59:58Should consider more of these questions and answers in fairness to the public so that we we get some knowledge

1:01:54I should say countless amounts of needles in my backyard. I'm trying to raise a family

1:02:10Individuals that attend there. I understand they need help

1:02:13That's not the place for them to get help. You can hear

1:02:19I've been threatened multiple times

1:02:34When there's no security

1:02:36And I was told personally

1:03:06So we do have the two adjacent houses beside the drop-in and we cannot raise our family there just to touch on

1:03:14His houses have been broken into his cars have been vandalized the needles

1:03:19Things have been stolen from the properties

1:03:23And we have been told by many people

1:03:26Management there that there's nothing that can be done. They don't have the funding

1:03:30We've gone to the police the police are like our hands are tied because essentially the courts are just going to toss out the

1:03:34There's nothing they can do to control

1:03:37What's happening there? So how are we going to allow this 400?

1:03:41470 increase

1:03:43Of beds there right to the they don't even have staff to take care of it now

1:03:48So as neighbors there

1:03:50Neighborhood who's going to control all these things that are happening there. So

1:03:54So what we have to sell the house? We have to move somewhere else in order to bring our kids there

1:03:58I think that's that's not safe when sister christine was there. We didn't have these kind of issues and now

1:04:03It's not even being run correctly and it doesn't matter like how many times that we're complained

1:04:08It just goes on deaf ears. It's almost like a joke to them because they just

1:04:13It is what it is and our heart goes out to all these people that need help

1:04:16But like how can you say let let's increase it by that amount of people and not have the staffing or the funding to take care of it

1:04:23Like we it needs to all be thought out and we do agree like the community should know there should be more information

1:04:30That goes out so people really know what is going on here because what's listed in here is not the problem

1:08:22The compliance with or variances from zoning regulations in place and that's that's what brings us here today, so

1:08:28um, but I think the questions the questions warrant some probably more informed explanations from

1:09:18this is a common kind of concern of neighborhoods when you're trying to

1:09:23balance the needs of individuals in our community that are homeless and

1:09:28within neighborhoods or with all of our other community members, so

1:09:33As an organization, this is something we do take seriously and we want to make sure everyone feels safe

1:09:41the people that

1:09:42need shelter and community members

1:09:45It's always a balance to do all this work and we'll do our best

1:09:51from uh

1:09:52I guess a human rights perspective

1:09:54We want to just consider the path of these conversations and the purpose of this meeting here

1:10:00Is if it's around land use or operations

1:10:04I'm not sure where the operational side of things fit

1:10:08but if it's a safety and operation

1:10:10I'll uh

1:10:11Question I can answer things and I'm not sure where that lands in terms of a conversation

1:11:14And that is my primary concern from the moment I read this application

1:11:19And is it desirable?

1:11:21And an appropriate development of the land and that is our concern

1:11:26And these are the two main questions that I've been grappling with

1:11:31Since I opened it up

1:11:34And uh, I don't think it's minor

1:11:38And I don't think it's desirable

1:11:41in that location and I

1:11:45Have to say that to you as uh, I you know I

1:11:5117 bit beds to 75 beds is substantial

1:11:56It's not minor. This is not the in my opinion

1:12:01This is not the avenue for this to take place. This is not the committee. This is a this is a zoning bylaw

1:12:10Issue not a this this is not for this is not ours. This is much too big for a committee of adjustment this issue

1:12:18Is is a bigger issue?

1:12:22And I'm sorry, but that's my opinion

1:13:06Um, I think as a community we wanted to be flexible around the numbers

1:13:11We need to be responsive to our members of our community that are homeless and the number kind of gives fluidity

1:13:17It doesn't mean that there would be 75 individuals. Uh, that isn't

1:13:23necessarily our demand today

1:13:25But we need to be responsive as a community. So that's why that number was put forward, but it wouldn't be an immediate

1:13:34Number that would be filled to capacity, but I think that would be

1:13:39Just leave room for our community to respond to the issue of homelessness, which is also

1:13:44What we're here talking about

1:13:51Through you, mr. Chair if I could just add a couple of things to and I say mark mark is here

1:13:56But one of the one of the questions that I did here and I I can

1:14:01Uh provide a bit of an answer to there was a question about funding and one of the reasons

1:14:06that were even here discussing this today

1:14:09is because the wellington county

1:14:13In its work to address the sort of the local homelessness issue

1:14:17wellington county secured funding from the province and I believe the feds as well mark could speak to that but

1:14:22Um, they have they have through a lengthy process secured long-term funding for

1:14:30The operation of this facility, which I believe and you correct me if I'm wrong

1:14:36Didn't previously exist and that's in part to try and address some of these ongoing

1:14:41concerns about how it operates day to day and year to year

1:14:44um, and so

1:14:46Part and parcel with that there's a lot of

1:14:49Provincial oversight as to how it can and has to be run

1:14:53Going through in the future and one of those things we were just discussing this earlier today in fact with with the county and and gale

1:15:01is that that number of 75

1:15:04practically speaking is probably

1:15:08Is probably not doable because it exceeds what the provincial

1:15:13Requirements and objectives of the third floor addition would be it would be

1:15:18It's geared towards a lighter accommodation number in the first instance

1:15:22And it was really just when we were discussing this with staff and trying to establish

1:15:28What's what's this sort of appropriate?

1:15:31message to bring to this committee in terms of potential worst case short-term accommodation

1:15:37when that new third floor was built with the 12th room sitting tails and

1:15:42sort of

1:15:43on

1:15:44Sort of not the not the long term objective of double occupancy, but worst-case scenario dead of winter

1:21:04we have an opportunity to hear,

1:21:07to approve something to keep a process working

1:21:11and to keep moving forward in a situation

1:21:13where there are no answers that I can see

1:21:16and this is a step in the right direction.

1:21:17And I kind of feel quite honored to be in a position

1:21:20to say yes to the parts we can say yes to.

1:21:26Like Member Bellaman, I have struggled with this

1:21:29and I think some of the answers that I've heard

1:21:34help sway me.

1:21:37I also have to say that I was moved

1:21:39by the members of the public who took the time

1:21:42and it's not easy to speak in public.

1:21:44So I thank you and I do appreciate

1:21:47and understand your comments.

1:21:53We're dealing with a planning matter

1:21:56and to speak to a couple of things that were raised.

1:21:59One is in terms of the format and the timing

1:22:03that has been a longstanding format for the City of Guelph.

1:22:09And under the hybrid formula,

1:22:11it's actually made it easier for citizens to come forward

1:22:16because as you may have noted

1:22:19that several of the applicants have been able to come forward

1:22:23while they're still at work.

1:22:24So they haven't had to take time off work

1:22:27and travel to City Hall and make a presentation

1:22:31that they've been able to make their presentation

1:22:34based on being able to come in virtually

1:22:37either via audio or video.

1:22:41So that being said, there was also the question raised

1:22:45about the circulation area

1:22:50and that is something that's legislated

1:22:52and if you as a citizen feel that you're not being well served

1:22:58with that, I think that's something

1:23:00that you may want to take up with your elected official.

1:23:02That has been a legislated standard for some time

1:23:06but I understand with a touchy subject like this one

1:23:10that you might feel that information wasn't as forthcoming.

1:23:15So I would urge members of the public who feel that way

1:23:20that they take this up with their elected official.

1:23:25Having editorialized that way,

1:23:27I am going to be supporting this motion.

1:23:29I have struggled with it as I've said

1:23:31but I believe that this is minor in nature

1:23:36and that it is defensible and it should go forward.

1:23:42So I will be supporting it.

1:23:52I understand your comments and I do understand the need.

1:23:58I mean, I've come from an area where I know

1:24:02there's a lot of need for people to live

1:24:07and I understand that there's funding available

1:24:10as I've just heard from the county and I appreciate that

1:24:15and I just, is this the right spot?

1:24:21Is this intensification to this degree

1:24:27the right way to do it?

1:24:30Can that intensification be put in different,

1:24:36can the money be put somewhere else?

1:24:39Is there a way to sort of spread it out a little bit

1:24:43so that we're not intensifying?

1:24:45Because this is an intensification

1:24:48by as someone pointed out 470% in one spot

1:24:54and that's a lot.

1:24:56That's not a minor thing for people who live near it

1:25:00and we have to think about the people around something

1:25:04that we're imposing something to describe as a minor variance.

1:25:12And that's why I'm feeling this way.

1:25:15I feel really, there's a lot of people

1:25:19that live in that condo that is within the area

1:25:25that of influence and that's why I'm,

1:25:28and we're impacting businesses,

1:25:31we're impacting a lot of things.

1:25:34So I'm thinking, is there a way that we can have people

1:25:38who are working in this business,

1:25:41think about ways to spread the money out so that,

1:25:44and use that money to build an expansion somewhere else

1:25:50or use a different building.

1:25:51You know, to make this work in the city,

1:25:56because we need it,

1:25:58but is this the right place to intensify?

1:26:02Well, I hear you and I appreciate a number of the points

1:26:08that you've raised, however, I'm, yeah.

1:26:13I don't think that we have any more comments.

1:27:22to recognize him for his dedication to the committee

1:27:25since his appointment in November, 2021.

1:27:28We will be sending a token of our appreciation

1:27:31for his service and our sending our best wishes.

1:27:34And as this has created an additional vacancy,

1:27:38we will be working with the city clerk's office

1:27:40to determine next steps to fill this vacancy.
