19:26I'm the designer for the project

19:28and I'm doing the minor variance on behalf of the owner.

19:32We are requesting a minor variance

19:34due to the proposed exterior staircase entry

19:39to an additional dwelling unit,

19:41leaving a side yard setback of 0.41 meters,

19:46whereas the bylaw requires 0.6 meters.

19:50And the basement layout we are proposing

19:53will only work with the exterior staircase entry

19:58being where it is proposed

20:00due to the utility room placement in the basement.

20:06So having the staircase in the backyard was not an option.

20:10Hence, we really require this minor variance

20:13in order to proceed with the construction

20:16of the additional dwelling unit.

20:19Also, I would like to add that the neighboring property

20:23already has an exterior staircase entry

20:26on the same side as our proposal.

20:31And the neighbors are in agreement with our plan

20:35and have no objections.

20:37The layout of the staircases will work out very well

20:41for both properties.

20:43In addition, I would like to add

20:45that currently we're facing a housing shortage

20:48and approval of this minor variance

20:51will allow for the creation of an additional dwelling unit

20:55which will not only sport the housing and rental shortage,

20:59it creates intensification,

21:01prospers the city and creates a lot of jobs,

21:05which we could use in tough time like these.

21:08Also, the official provincial policy statement

21:12of 2020 promotes efficient land use

21:16and cost effective development patterns

21:18to minimize land consumption and servicing costs.

21:22Therefore, the approval of this minor variance

21:26will assist with fulfilling the provincial policy statement

21:30by minimizing land consumption and servicing costs.

25:04First of all, I wanna thank Scott Wilson,

25:06Shefane Daniel, and Kelly Patzer for their help.

25:10I've been going through this process for some time

25:12and it's been a grueling process to say the least.

25:15I'm applying for a driveway and also to kind of redo

25:19the front porch.

25:21It's on Bristol Street, which is an old street

25:23and the property lines are set back very close

25:26to the existing homes.

25:27The original house was built in the early 1900s

25:31and in the 1960s, the original owner

25:34eliminated their driveway and put in a front porch

25:37and cold cellar.

25:39At that point, it lost its legal non-conforming status

25:42for the driveway and I'm kind of in the process

25:45of trying to get that back.

25:47So basically I'm just looking for the ability

25:50to have a driveway for my family and remove that porch,

25:54which if anybody has seen it, it sticks out like a sore thumb

25:58and beautify the already beautiful street.

26:02So that's it.

26:03Otherwise, I hope it's pretty straightforward.

29:13This is an application fee refund request

29:16for file A-29-22 for 10 Palmer Street.

29:21This application was deferred at the May 26, 2022 hearing

29:26at the request of staff and with the owner's agreement

29:29to allow additional time to investigate

29:31an encroachment agreement and submit a revised application.

29:35On June 3rd, the owner indicated

29:37that the application would be withdrawn.

29:39Staff then received a request to refund the application fee

29:42in full for this withdrawn application.

29:46Staff comments regarding this refund request

29:48have been provided and staff is recommending refusal

29:51of the refund request to ensure costs are recovered

29:53for the review and recirculation

29:58and circulation of the application.

30:14I understand where the applicant's coming from

30:16as the committee didn't end up making

30:18an approval or a refusal decision,

30:20but I think that the reason for the cost

30:24is that for the city staff background to it

30:26and I think we should refuse this.

31:01It just, I did have a comment that I did feel

31:06where you were saying the current policy

31:09does not specifically speak to situations

31:12in which a previously deferred application

31:14is then withdrawn.

31:15And also that you may be looking into that

31:19to make it more clear for these different situations

31:24that haven't been addressed,

31:25that perhaps like is that on the table?

31:32Through the chair to member Allison,

31:34that's something that we've been looking at

31:35and we've had a few conversations with the chair as well.

31:38So as you correctly identified,

31:40typically for fee refund requests

31:44regarding withdrawn applications,

31:46since this fee refund policy was approved back

31:49in September, 2021, with that policy,

31:53technically the secretary treasurer has authority

31:56to issue refunds as per the schedule.

31:59This was a bit of a different situation

32:01in terms of it was a withdrawn application,

32:04except for the applicant didn't agree with the policy.

32:09And after discussing with the chair on how to proceed,

32:12we felt it was appropriate to come to the committee

32:14in this consideration.

32:17Right now the policy doesn't have,

32:18isn't as silent about any like appeal process

32:22or what to do if there's disagreement with the applicant.

32:25So that's why this is a bit of a unique situation.

32:28And we felt that we'll leave that up to the committee

32:30to decide, but typically with withdrawn applications,

32:33those are refunded automatically by staff

32:37according to what stage they meet on that schedule.

32:40So there's the four stages we have there.

32:42So we've created a bit of flexibility

32:44in terms of depending on when someone withdraws

32:47an application and that stage is dependent upon

32:51how much staff time is put in the application.

32:53So if someone submits an application

32:55and immediately withdraws, then there's a certain percentage

32:59of the fee, a majority of the fee is refunded

33:03to the applicant.

33:04But once a notice has gone out, staff comments

33:06have been compiled and a public hearing has been held.

33:10We don't recommend a refund of the application fee

33:17and simply for the purpose that most of the application fee

33:20has already been expended by the staff time

33:23to review the application as well.

33:25So one thing that we've noted on that policy

33:29is there is a notation on stage four

33:31that talks about the application being withdrawn

33:34after a public hearing and it does reference about

33:38a decision to approve or refuse as made by the committee.

33:41It doesn't reference the words with deferred application

33:46at all.

33:47So that's something that we can provide some extra clarity

33:50on the policy or we can continue to deal with those refund

33:56requests on a site by site basis.

34:15when this initially came.

34:16I just had a question for staff.

34:17I'm just wondering if there was any discussion

34:20with the applicant at the time of when he first applied

34:22to about any of the issues that,

34:25or are the issues come later after the time of application?

34:28Just trying to get a sense of whether there was any warning

34:30at all at the time of application

34:32that there might be some serious issues

34:33with the application.

34:35I don't know if anybody in town staff

34:37can speak to that tonight or not.

34:39Through the chair to member Hamilton, I can.

34:42This is an application that came in

34:44that didn't have prior planning consultation.

34:46So it was only found out when staff were asked

34:49to provide comment of the concerns with the encroachment.

34:52It was at that time we began a dialogue

34:55with the applicant about options

34:57and let them decide what was best for them

34:59and their property.

35:00And it was understandably that their direction

35:03was to withdraw.

35:05There was a lot of time and energy put in from staff

35:08with regard to helping this applicant get to a place

35:11of complying with the current rules and regulations.

35:15So that fee does kind of go into those side works as well.

35:20But to answer the initial question, member Hamilton, yes.

35:25There was a discussion had after the application was made

35:31and once we were aware of what they were being proposed.

35:41Yeah, I think a point to make here is that the onus

35:47is on the owner in order to, when they submit

35:51and also to Scott made a good point there

35:53in terms of there is sort of a pre-application you can make

35:58in which you can sort of find out what your

36:02what's necessary and it's not, it's minimal,

36:07it's minimal amount.

36:08So there's that option that the owner can take as well.

36:13I just feel like the onus is on the owner when they submit

36:17and when they continue through their submission

36:21rather than the onus being on the city for the city

36:24to have to refund the applicant.

37:41It was listed on the agenda and it's just a quick update

37:45regarding the location of upcoming

37:48committee of adjustment hearings.

37:50As council chambers is undergoing renovations

37:53and upgrades starting in late July,

37:55this means that starting the next regularly scheduled

37:58hearing on August 11th,

38:00hearings will be held remotely without in-person attendance.

38:04So this will be similar to how hearings were held prior

38:07to the switch to the hybrid format in May.

38:11And it's anticipated that chambers will be available

38:14sometime in mid-November.

38:16So this would affect the regularly scheduled hearings

38:19for a period from August until November.

38:24That's the only staff announcement that we have

38:25at this time, but I'm happy to answer any questions

38:28the committee might have.
